Comment 2 : Mark Hudson expressed concern that the fee schedule
amendments pose an unfair burden on lower income rate payers compared to
higher income and commercial rate payers because the rates for large residential
and commercial /industrial are lower than those of small and medium residential.
Response The proposed amended rates posted in the notice inadvertently
omitted the phrase "per 1,000 square feet" from the impervious surface rates for
large residential and commercial /industrial users and from the street - related rate
for commercial /industrial users. The fee schedule attached to this Order has
been corrected to clarify that impervious surface rates for small and medium
residential are charged a flat rate, whereas impervious surface rates for large
residential and commercial /industrial are charged a rate per 1,000 square feet. In
addition, the street - related rate for commercial /industrial is charged per 1,000
square feet, whereas the street - related rates for small, medium and large
residential are flat rates.
E. Pursuant to EC 6.411 (1), the amended charges were determined after conducting
an investigation of the revenue needs of the City in providing the stormwater services. Based on
that investigation and the applicable criteria set out in EC 6.411(2), I find that the amended
Stormwater User Fee Schedule attached as Exhibit A should be implemented and effective for all
bills issued on or after September 1, 2014.
On the basis of these findings, I order that:
1. A copy of this Order shall be forwarded to the Mayor and City Councilors.
Unless reviewed by the Council, this Order shall become effective on the 11th day after the date
it is rendered.
2. Notwithstanding the effective date of this Order as set forth above, the
Stormwater User Fees attached as Exhibit A are established as the fees to be charged for the
described services, effective for all bills issued on or after September 1, 2014.
3. Any unamended fees established by Administrative Order No. 58- 12 -03 -F remain
in full force and effect and are incorporated into the updated fee schedule attached as Exhibit A.
4. Administrative Order No. 58- 12 -03 -F is repealed as of the effective date of the
fees attached as Exhibit A to this Order.
Dated this Q'7r ,4day of July, 2014.
Jon R. Ruiz
City Manager
This Order becomes final on July _Z , 2014.
Administrative Order -- Page 2 of 2
