ADMINISTRATIVE ORDER NO. 44-15-03-F <br />of the <br />City Manager of the City of Eugene <br />ESTABLISHMENT OF A TRANSIENT ROOM TAX SERVICE FEE FOR <br />CREDIT CARD PAYMENTS. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager of the City <br />of Eugene to determine and set fees and charges to be imposed by the City for services, goods, <br />use of municipal property, and licenses and permits. <br />B. The City has provided businesses paying Transient Room Tax payments the <br />option to pay by credit card. This is offered as a convenience to the businesses. The City's <br />merchant account provider charges fees for processing Transient Room Tax credit card <br />payments, which the City has been absorbing. The processing fees have increased tenfold since <br />2006. Due to the increasing processing fees, on July 10, 2015, I issued Administrative Order No. <br />44-15-03 proposing to establish a 2.9% service fee for credit card payments of Transient Room <br />Taxes in order to pass-through the processing fee onto businesses that pay by credit card. Notice <br />of the proposed fee was attached as Exhibit A to Administrative Order No. 44-15-03. <br />C. A copy of the Notice was provided to the Mayor and City Councilors, and made <br />available to persons who had requested such notice. A copy of the Notice was also posted at two <br />locations at City Hall on July 15, 2015. The Notice provided that written comments would be <br />received for a period of 15 days from the date of posting. No comments were received within <br />the time or in the manner provided in the Notice. <br />D. In determining the fee, I have considered the applicable policies, enactments and <br />directives of the City Council, the full costs of providing the service supported by the fee, and <br />the amounts charged by other comparable providers. I have not considered the amount charged <br />for this service by the City in the past because the City has not previously charged a Transient <br />Room Tax service fee. Nor have I considered the revenue needs of the City as determined by the <br />adopted City budget because the decision to establish this service fee was not determined as part <br />of the budget process. <br />On the basis of these findings, I order that businesses paying Transient Room Taxes <br />by credit card shall be charged a 2.9% service fee. The City shall not receive any portion of the <br />service fee; rather, proceeds from the service fee shall be remitted directly to the City's merchant <br />account provider to cover the cost of processing the credit cards. <br />Dated and effective this day of UP f__ , 2015. <br />Jon R.
