The <br />applicant requests annexation of a portion of Tax Lot 201 as shown on Exhibit B of Attachment A. The <br />Planning Director recommends that the City Council approve this annexation request, pursuant to <br />Eugene Code (EC) 9.7820(1)(d)(1). <br /> <br /> <br />BACKGROUND <br />In December 2007, the City Council adopted an ordinance establishing the procedures for annexation <br />requests. EC 9.7820(1)(d) provides for the council to adopt a resolution approving, modifying and <br />approving, or denying the application for annexation. Alternatively, this section also provides the option <br />for council to hold a public hearing before consideration of the annexation request. Approval of <br />annexation applications are based on the criteria at EC 9.7825 which require that (1) the land proposed <br />to be annexed is within the city’s Urban Growth Boundary (UGB) and is contiguous to the city limits or <br />separated from city limits only by a right-of-way or water body; (2) the proposed annexation is <br />consistent with the applicable policies in the Metro Plan and in any applicable refinement plans and (3) <br />the proposed annexation will result in a boundary in which the minimal level of key urban facilities and <br />services can be provided in an orderly, efficient, and timely manner. <br /> <br />Public notice was provided in accordance with EC 9.7820(1)(c), and no written testimony has been <br />received. As discussed in the attached findings, the proposed request is a fairly typical annexation <br />request for a property that is within the urban growth boundary, is contiguous to city limits and can be <br />provided with the minimum level of key urban services, consistent with the approval criteria. Given the <br />findings of compliance, lack of testimony received, and non-controversial nature of the request, a public <br />hearing is not recommended in this instance. <br /> <br />Approval of an annexation request requires the City to adopt a resolution. To comply with the Charter <br />requirements for resolutions, a draft resolution approving the requested annexation has been prepared <br />and is attached for reference (Attachment A). The Planning Director’s findings, which provide analysis <br />of the proposal’s compliance with applicable approval criteria, are attached to the draft resolution as <br />Exhibit C.
