`7 l~ ORDINANCE N0. 8634 ~to-wit: An ordinance initiating the vacation of the following described premises, That portion of 21st Avenue-West lying between the East line of Olive Street and the West line of ti'lillamette Street, excepting therefrom that portion of the alley running North and South between Olive Street and McMillan Street; that portion of the alley running northerly and southerly between Willamette Street and McMillan Street, and that portion of ~TcMillan Street running North and South through said 21st Avenue West, all as shown b y the Engineer's map which is incorporated herein by reference. calling a hearing and directing that notice be given. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Common Council of the City of Eugene hereby initiates station proceedings on its own authority without petition or consent of the roperty owners, excepting as provided by statute, of the following described roperty, to-wit: That portion of 21st Avenue West lying between the East line of Olive Street and the West line of Willamette Street, excepting there- from that portion of the alley running North and South between Olive Street and McMillan Street; that portion of the alley running northerly and southerly between Willamette Street and T~cMillan Street, and that portion of McMillan Street running North and South through said 21st Avenue West, all as shown by the Engineer's map which is incorporated herein by reference. `{~ Section 2. A hearing shall be held upon the proposal to vacate the street (as herein provided, and_said hearing shall be had on the 13th day of May, 1940, at `the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock p:m. of said day, at wYiich time all persons will be heard upon objections or suggestions with reference to the vacation of said street, and at said time the Council provide for the vacation of said premises or deny such vacation, and in case the vacation is made will make provisions for any damages Sustained, by local assessment. Section 3. The City Recorder be and he is hereby required to immediately ublish for four consecutive weeks in a newspaper published in Eugene, Lane ounty, Oregon, the newspaper selected by him is hereby designated as the fficial newspaper of the city for this purpose, notice of the proposed vacation. uch notice shall give the description of the area to be vacated as herein set ut, and state the date when this ordinance was passed; the name of any etitioners petitioning fo r said vacation; the date when the said petit ion, ogether with any objection or remonstrances which may be made in writing and filed ith the City Recorder prior to the date of said hearing, will be heard and onsidered. ~ Section 4. The City Recorder shall forthwith and within five days after the first publication of said notice, post or cause to be posted at or near each end of said proposed vacation, a copy of the foregoing notice which shallbe headed "NOTICE OF STREET VACATION", and which notice shall be posted in at least two conspicuous places in such proposed vacation of such area. The posting and the first day of publication of such notice shall be not less than twenty-eight days before the time set for hearing. 1 Section 5. WHERE~IS, the above described street proposed to be vacated its of .such a surface character as to render it dangerous and difficult and expensive +to maintain and of no value as a street of the city, an emergency is hereby declared to exist and it is declared to be necessary for the immediate preserva- ~tion of the peace, health and safety of the city of Eugene that this ordinance Make effect immediately upon its `passage by the Common Council and its approval by the Mayor, and it is so ordered.
