`7 l~ <br />ORDINANCE N0. 8634 <br />~to-wit: <br />An ordinance initiating the vacation of the following described premises, <br />That portion of 21st Avenue-West lying between the East line <br />of Olive Street and the West line of ti'lillamette Street, <br />excepting therefrom that portion of the alley running North and South <br />between Olive Street and McMillan Street; that portion of the <br />alley running northerly and southerly between Willamette Street and <br />McMillan Street, and that portion of ~TcMillan Street running <br />North and South through said 21st Avenue West, all as shown <br />b y the Engineer's map which is incorporated herein by reference. <br />calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />station proceedings on its own authority without petition or consent of the <br />roperty owners, excepting as provided by statute, of the following described <br />roperty, to-wit: <br />That portion of 21st Avenue West lying between the East line <br />of Olive Street and the West line of Willamette Street, excepting there- <br />from that portion of the alley running North and South between Olive <br />Street and McMillan Street; that portion of the alley running northerly <br />and southerly between Willamette Street and T~cMillan Street, and that <br />portion of McMillan Street running North and South through said <br />21st Avenue West, all as shown by the Engineer's map which is incorporated <br />herein by reference. <br />`{~ Section 2. A hearing shall be held upon the proposal to vacate the street <br />(as herein provided, and_said hearing shall be had on the 13th day of May, 1940, at <br />`the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock p:m. of <br />said day, at wYiich time all persons will be heard upon objections or suggestions <br />with reference to the vacation of said street, and at said time the Council <br />provide for the vacation of said premises or deny such vacation, and in case the <br />vacation is made will make provisions for any damages Sustained, by local <br />assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />ublish for four consecutive weeks in a newspaper published in Eugene, Lane <br />ounty, Oregon, the newspaper selected by him is hereby designated as the <br />fficial newspaper of the city for this purpose, notice of the proposed vacation. <br />uch notice shall give the description of the area to be vacated as herein set <br />ut, and state the date when this ordinance was passed; the name of any <br />etitioners petitioning fo r said vacation; the date when the said petit ion, <br />ogether with any objection or remonstrances which may be made in writing and filed <br />ith the City Recorder prior to the date of said hearing, will be heard and <br />onsidered. <br />~ Section 4. The City Recorder shall forthwith and within five days after <br />the first publication of said notice, post or cause to be posted at or near each <br />end of said proposed vacation, a copy of the foregoing notice which shallbe headed <br />"NOTICE OF STREET VACATION", and which notice shall be posted in at least two <br />conspicuous places in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be not <br />less than twenty-eight days before the time set for hearing. <br />1 Section 5. WHERE~IS, the above described street proposed to be vacated <br />its of .such a surface character as to render it dangerous and difficult and expensive <br />+to maintain and of no value as a street of the city, an emergency is hereby <br />declared to exist and it is declared to be necessary for the immediate preserva- <br />~tion of the peace, health and safety of the city of Eugene that this ordinance <br />Make effect immediately upon its `passage by the Common Council and its approval <br />by the Mayor, and it is so ordered. <br />PASSED BY THE COMMON COUNCIL APPROVED BY THE MAYOR THIS <br />this 25th day of March, 1940 25th day of March, 1940 <br />ls/ C.
