72 <br />ORDINANCE N0. 8635 <br />An Ordinance initiating the vacation of the following described premises, <br />to-wit: <br />Beginning at the Northeast corner of Alpha Place Addition as <br />platted and recorded in Lane Q~unty, Oregon Plat records <br />running thence South 830 25' 1Nest 147.69 feet to the Northeast <br />corner of Lot 20 in said addition thence along a curve to the <br />left the radius of which is 100 feet to a point 10 feet from the <br />North line of said addition, thence North 83° 25' East to the West <br />line of Vdillamette Street thence North 14° 13' West 10.09 feet to the <br />place of beginning, being a strip of land 10 feet wide lying within <br />Grand View Drive. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOV~IS: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority without petition or consent of the proper <br />owners, excepting as provided by statute, of the following described property, <br />to-wit: <br />Beginning at the Northeast corner of Alpha Place Addition as platted and <br />recorded in Lane County, Oregon Plat Records running thence South 83° 25' 4'dest <br />147.69 feet to the Northeast corner of Lot 20 in said addition thence along a curve <br />to the left the radius of which is 100 Peet to a point 10 feet from the <br />North line of said addition, thence North 83° 25' East to the 6jlest line <br />of ~°3illamette Street thence North 140 13' West 10.09 feet to the <br />place of beginning, being a strip of land 10 feet wide lying within <br />Grand View Drive. <br />Section 2. A hearing shall be held upon the proposal to vacate the portion <br />'of said street as herein provided, and said hearing shall be had on the 13th day <br />of May, 1940, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 <br />o'clock p.m. of said day, at which time all persons will be heard upon objections <br />or suggestions with reference to the vacation of said portion of street, and at <br />said time the Council will provide for the vacation of said premises or deny such <br />vacation, and in case the vacation is made will make provisions for any damages <br />sustained, by local assessment. <br />Section 3. The pity Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane County, <br />Oregon, the newspaper selected by him is hereby designated as the official newspape <br />of the city for this purpose, notice of the proposed vacation. Such notice shall <br />give the description of the area to be vacated as herein set out, and state the <br />date when this ordinance was passed; the name of .any petitioners petitioning for <br />said vacation; the date when the said petition, together with any objection or <br />remonstrances which may be made in writing and Piled with the City Recorder prior <br />to the date of said hearing, will be heard and considered. <br />~ Section 4. The City Recorder shall forthwith and within five days after the <br />first publication of said notice, post or cause to be posted at or near each end <br />Hof said proposed vacation a copy of the foregoing notice which shall be headed <br />"NOTICE OF STREET VACATION", and which notice shall be posted in at least two <br />iconspicuous places in such_proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be not <br />less than twenty-eight days before the time set for hearing. <br />Engineer that Grand View Drive as it enters V'Jillamette Street should properly be <br />(located ten feet farther South than at present located and it is necessary and <br />desirable tY~it the change be made before further improvements are made upon the <br />street, an emergency is hereby declared to exist and it is deemed to be necessary <br />for the immediate preservesion of the peace, health and safety of the City of Eugene <br />(that this ordinance take eff eet immediately upon its passage by the Common Council <br />Viand its approval by the Mayor, and it is so ordered. <br />Section 5.
