'~ 3 <br />ORDINANCE N0. 8636 <br />An Ordinance initiating the vacation of the following described premises, <br />to-wit: <br />Commencing at the Portheast corner of Lot 1, Block 2, <br />Rugh's Second Addition to the City of Eugene, and thence <br />South along the Vilest side of Ramey Street to the Southeast <br />Corner of Lot 5, said Block, thence East 10 feet, thence North <br />to a point 10 feet East of the place of beginning and <br />thence West to beginning; being the West 10 Peet of <br />Ramey Street fronting on Lots 1, 2, 3, 4, and 5, Block 2, <br />Rugh's Second Addition to Eugene, Lane County, Oregon <br />~l <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority without petition or consent of the <br />property owners, excepting as provided by statute, of the following described <br />property, to-wit: <br />'~ Section 2. A hearing shall be held upon the proposal to vacate the street <br />',land alley as herein provided, and said hearing shall be had on the 13th day of May, <br />Ii1940, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock <br />p.m. of said day, at which time all persons will be heard upon objections or <br />j!suggestions with reference to the vacation of said portion of street, and at said <br />'~~time the Council will provide for the vacation of said premises or deny such <br />.vacation, and in case the vacation is made will make provisions for any damages <br />sustained, by local assessment. • <br />h Commencing at the Northeast corner of Lot 1, Block 2, Rugh's <br />Second Addition to the City of Eugene, and thence South <br />Il along the West Side of Ramey Street to the Southeast Corner <br />1 of Lot 5, said Block, thence East l0 feet, thence North <br />~~ to a point 10 feet East of the place of beginning and• <br />`~ thence Vest to beginning; being the West 10 feet of Ramey <br />Street fronting on Lots 1, 2, 3, 4, and 5, Block 2, <br />Rugh's Second Addition to Eugene, Lane County, Oregon <br />~j <br />Section 3. The City Recorder be and he is hereby required to immediately <br />ublish for four consecutive weeks in a newspaper published in Eugene, Lane County,. <br />regon, the newspaper selected by him is hereby designated as the official newspaper <br />f the city for this purpose, notice of the proposed vacation. Such notice shall <br />ive the description of the area to be vacated as herein set out, and state the date <br />hen this ordinance was passed; the name of any petitvners petitioning for said <br />acation; the date when the said petition, together with any objection or remonstrant <br />hick may be made in writing and filed with. the City Recorder prior to the date of <br />aid hearing, will be heard and considered. <br />Section 4. The City Recorder shall forthwith and within five days after the <br />irst publication of said notice, post or cause to be posted at or near each end of <br />aid proposed vacation, a copy of the foregoing notice which shall be headed "Notice <br />f Street Vacation", and which•.notice shall be posted in at least two. conspicuous <br />laces in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be not <br />ess than twenty-eight days before the time set for hearing. <br />Section 5. 1Plhereas it has been discovered that Ramey Street as platted was <br />isplaced and the occupancys of the adjoining properties have been established based <br />pon the proper location of Ramey Street, leaving a confusion in descriptions and an <br />ncertainty in possession that must be corrected forthwith, an emergency is hereby <br />ecla red to exist and it is declared to be necessary for the immediate preservation <br />f the peace, health and safety of the city of Eugene that this ordinance take effec <br />mmediately upon its passage by the Common Council and its approval by the Mayor, <br />nil it is so ordered. <br />sed by the Common Council <br />is 8th day of April, 1940 <br />s <br />ty <br />Approved by the Mayor this <br />10th day of April, 1940 <br />~s/ Elisha Lame <br />Mayor <br />s <br />
