r <br />'7 4 <br />~~ <br />ORDINANCE N0. 8637 ~~ <br />______~ <br />i <br />i <br />~~ <br />An Ordinance initiating the vacation of the following described premises, <br />ito-wit: ~ <br />i ~ <br />The East 13 feet and the West 13 feet of Emerald Street <br />between 24th and 25th Avenues East in the City of Eugene, <br />Iane County, Oregon, leaving Emerald Street 40 feet in width. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates i' <br />vacation proceedings on its own authority without petition or consent of the property <br />owners, excepting as provided by statute, of the following described property, to-wi;t: <br />The East 13 feet and the West 13 Peet of Emerald I,I <br />Street between 24th and 25th Avenues East in the City ~I <br />of Eugene, Lane County, Qregon, leaving Emerald <br />Street 40 feet in width." <br />Section 2. A hearing shall be held upon the proposal to vacate the street ,I <br />as herein provided, and said hearing shall be had on the 10th day of June, 1940, at~~~~, <br />the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock p.m. of <br />said day, at which time all persons will be heard upon objections or suggestions I~, <br />with reference to the vacation of said portion of said street, and at said time the ', <br />Council will provide for the vacation of said premises or deny such vacation, and <br />in case the vacation is made will make provisions for any damages sustained, by I~ <br />local assessment. , <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane County, <br />;Oregon, the newspaper selected by him is hereby designated as the official newspaper <br />of the city for this purpose, notice of the proposed vacation. Such notice shall <br />igive the description of the area to be vacated as herein set out, and state the <br />date when this ordinance was passed; the name of any petitioners petitioning for <br />(said vacation; the date when the said petition, together with any objection or <br />,remonstrances which may be made in writing and filed with the City Recorder prior <br />Ito the date of said hearing, will be heard and considered. <br />Section 4. The City Recorder shall forthwith ;and within five days after <br />the first publication of said notice, post or cause to be posted at or near each <br />lend of said proposed vacation, a copy of the foregoing notice which shall be headed <br />;"Notice of Street Vacation", and which notice shall be posted in at least two <br />conspicuous places in such proposed vacation of such area. <br />i <br />. The posting and the first day of publication of such notice shall be not <br />'less than twenty-eight days before the time set for hearing. <br />Section 5, Whereas, an unplatted area has been laid out by John P. Harpham <br />hand William H. Hodes and the plat is being filed vri th the approval of the City <br />;Planning Commission and the Common 6ouncil, and it is necessary that the street <br />shall be made to conform to the plat as filed and dedicated. <br />Therefore, an emergent is hereby declared to exist and it is declared to <br />be necessary for the immediate reservation of the peace, health and safety of the <br />City of Eugene that this ordinance take effect immediately upon its passage by the <br />Common Council and its approval by the Mayor, and it is so ordered. <br />.Passed by the Common Council <br />this 22nd day of April, 1940 <br />Approved by the Mayor this <br />27th day of April, 1940 ~~,;I <br />I <br />C.
