'7 5 <br />ORDINANCE N0. 86 8 <br />An Ordinance vacating the following described area, to-wit: <br />That portion of 21st Avenue West lying between <br />the East line of Olive Street and the West line <br />of 1illamette Street, excepting therefrom that portion <br />of the alley running North and South between Olive Street <br />and McMillan Street; that portion of the alley running <br />northerly and southerly betti~aeen Villamette Street and <br />McMillan Street, and that portion of McMillan Street <br />running North and South through said 21st Avenue <br />West, all as shown by the Engineer',s map which is <br />incorporated herein by reference. <br />WHEREAS, heretofore and on the 25th day of March, 1940 the Common Council <br />of the City of Eugene passed an Ordinance setting a hearing for the 13th day of <br />Nlay, 1940 in the Council Chambers, at which time and place protests and remonstrance <br />could be heard as to the vacation of the following premises, to-wit: <br />That portion of 21st Avenue West lying between <br />the East line of Olive Street and the West line <br />of Willamette Street, excepting therefrom that <br />portion of the alley running North and South <br />betvreen Olive Street and McMillan Street; that <br />portion of the alley running northerly and southerly betvueen <br />Willamette Street and McMillan Street, and that <br />portion of McPvIillan Sheet running North and South through <br />said 21st Avenue VTest, all as shown by-the Engineer's <br />map which is incorporated herein by reference. <br />,~ and , <br />~ WHEREAS, a hearing was held pursuant to said Ordinance in the Council <br />Chambers in the City Hall in .the City of Eugene on Monday, the 13th day of May, <br />'1940 at 7:30 o'clock p.m. and at said time the Council heard all objections, and <br />WHEREAS, all persons owning property abutting upon said street proposed <br />to be vacated have consented to said vacation and have applied for said vacation, <br />the said street being of such a surface character as to render it dangerous and <br />difficult and expensive to maintain and of no value as a street of the city, <br />NOV~f, THEREFORE, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOV~IS: <br />I Section 1. The Common Council of the City of Eugene finds that due and <br />legal notice of said hearing was published and posted as required by law; that no <br />valid objection has been made at said hearing, or filed; that the consent of the <br />owners of the abutting property, properly acknowledged, has been filed in said <br />proceeding; and that the public interest will not be prejudiced by the vacation of ~' <br />(said street. <br />{ Section 2. That said hearing was held on the 13 th day of May, 1940 at <br />~7: 30 o'clock p.m. in the Council Chambers of the City Hall in Eugene, Lane County, <br />Oregon, and that all matters necessary to be done have been completed;, reserving <br />`however, to the City of Eugene right of way for maintaining or placing and maintaini <br />jipublic utilities of the city in said vacated area. <br />Section 3. That the following described area, to-wit: <br />~ That portion of 21st Avenue l~'Jest lying between <br />the East line of Olive Street and the West line <br />of Willamette Street, excepting therefrom that p <br />portion of the alley running North and South <br />l~ between Olive Street and T~JIcMillan Street; that <br />l portion of the alley running northerly and <br />Southerly between Willamette Street and McMillan <br />Street, and that portion of McMillan Street <br />running North and South through said 21st Avenue <br />West, all as shown by the Engineer's map which is <br />incorporated herein by reference. <br />e and the same is hereby vacated and the area so vacated, being a street, shall revert <br />o the abutting property pursuant to the statutes of the State of Oregon. <br />Section 4. The Recorder be and he is hereby directed to file a certified <br />opy of this ordinance with the Recorder of Lane County, Oregon, together with a <br />
