' ORDINANCE N0. 8647 <br />An Ordinance vacating the following described area, to-wit: <br />~~ The East 13 feet and the S'Uest 13 feet of Emerald Street <br />between 24th and 25th Avenues East in the-City of Eugene, <br />~ Lane County, Oregon, leaving Emerald Street 40 feet in <br />~i width. <br />i! <br />~I Y~REAS, Heretofore and on the 22nd day of April, 1940 the Common <br />~Couneil of the City of Eugene passed an Ordinance setting a hearing for the 10th <br />day of June, 1940 in the Council Chambers, at which time and place protests and <br />;~iremonstrances could be heard as to the vacation of the following premises, to-wit: <br />The East 13 feet and the 4`lest 13 feet of Emerald Street <br />between 24th and 25th Avenues East in the City of Eugene, <br />Lane County, Oregon, leaving Emerald Street 40 feet in <br />width. <br />and <br />1 WHEREAS, A hearing was held pursuant to said Ordinance in the Council <br />~~IlChambers in the City Hall in the City of Eugene on Monday, the 10th day of June, <br />11940, at 7:30 o'clock'P.M. and at said time the Council heard all objections, and <br />1 WHEREAS, all persons owning roperty abutting upon said street pro- <br />posed to be vacated have consented to said vacation and have applied for said <br />~ivacation, it being the purpose of said vacation to make said street conform to <br />';the plat of that certain unplatted area-which has been laid out by John P. Harpham <br />!and William H. Ho~.es and filed with the approval of the City Planning Commission <br />j'~,and the Common Council, as filed and dedicated. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLZ04JS: <br />Section 1. The Common Council of the City of Eugene finds that due <br />and legal notice of said hearing was published and posted as required by law; <br />that no valid objection has been made at said hearing, or filed; that the consent <br />of the owners of the abutting property, properly acknov.~ledged, has been filed in <br />said proceeding; and that the public interest will not be prejudiced by the va- <br />cation of said portion of said street. <br />Section 2. That said hearing was held on the 10th day of June, 1940 <br />at 7:30 o'clock r.M. in the Council Chambers of the City Hall in Eugene, Lane <br />County, Oregon, and that all matters necessary to be done have been completed. <br />Section 3. That the following described area, to-~vit: <br />The East 13 feet and the West 13 feet of Emerald Street <br />between 24th and 25th Avenues East in the City of Eugene, <br />Lane County, Oregon, leaving Emerald Street 40 feet in <br />width. <br />Abe and the same is hereby vacated and the area so vacated, being a portion of a <br />street, shall revert to the abutting property pursuant to the statutes of the <br />State of Oregon. <br />Section 4. That there is retained to the City of Eugene the right to. <br />install, maintain and repair any necessary public utilities, and the additional <br />right to enter upon the premises for such purposes. <br />Section 5.
