96 <br />ORDINANCE N0. 8654 <br />An ordinance initiating the vacation of the following described premises, <br />to-wit: <br />That certain plaza known as "Community Driver' commencing <br />at the intersection of the East line of Mill Street <br />with the North line of Tenth Avenue East, being thirty <br />(30} feet wide and entering a central drive seventy-four <br />(74} feet wide and known as "Community Drive" as platted <br />in Luckey Lane Subdivision of Eugene, Oregon and abutting <br />upon Lots 1, 2, 3 and 4 of said Subdivision. <br />and calling a hearing and directing that notice be given. <br />_ THE CITY OF EUGET~7E DOES OPDASN AS FOLLO~I~S: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority without petition or consent of the <br />property owners, excepting as provided by statute, of the following described <br />property, to-wit: <br />That certain plaza known as "Community Drive" commencing at <br />the intersection of the East line of Mill Street with <br />the North line of Tenth Avenue Fast, being thirty <br />(30) feet wide and entering a central drive seventy-four <br />(74) feet wide and known as "Community Drive" as platted <br />in Luckey Lane Subdivision of Eugene, Oregon and abutting <br />upon Lots 1, 2, 3, and 4 of said Subdivision. <br />Section 2. A hearing shall be held upon the proposal to vacate the street <br />nor drive as herein provided, and said hearing shall be had on the 23rd day of <br />September, 1940, at the Council Chambers in the City Hall in Eugene, Oregon at <br />7:30 o'clock p.m. of said day, at which time all persons will be heard upon objec- <br />tions or suggestions with reference to the vacation of said portion of street or <br />drive, and at said time the council will provide for the vacation of said premises <br />for deny such vacation, and in case the vacation is made will make provisions for <br />iany darnages sustained, by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane <br />County, Oregon, the newspaper selected by him is hereby designated as the official <br />newspaper of the city for this purpose, notice of the proposed vacation. Such <br />notice shall give the description of the area to be vacated as herein set out, and <br />state the date vahen this ordinance was passed; the name of any petitioners petition <br />ing for said vacation; the date wYien the said petition, together vrith any objection <br />or remonstrances which may be made in writing and filed with the City Recorder <br />prior to the date of said hearing, will be heard and considered. <br />Section 4. The City Recorder shall fort with and within five days after <br />the first publication of said notice, post or cause to be posted at or near each <br />end of said proposed vacation, a copy of the foregoing notice which shall be headed <br />"NOTICE OF STREET VACATION", and which notice shall be posted in at least two <br />conspicuous places in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be not <br />less than twenty-eight days before the time set for hearing., <br />Section 5. V`Thereas, it is proposed to place a hospital upon Lots 1, 2, <br />3 and 4 of Luckey Lane Subdivision, Eugene, Oregon, which will rest upon not only <br />the lots but upon the Community Drive, and <br />Whereas, construction is about to start and unless the area is vacated <br />accidents may result from persons entering said drive, an emergency is hereby <br />declared to exist and it is declared to be necessary for the immediate preservatie~n <br />of the peace, health and safety of the City of Eugene that this ordinance take <br />effect immediately upon its passage by the Common Council and its approval by the <br />Mayor, and it is so ordered. <br />Passed by the Cozarnon Council <br />this 12th day of August, 1940 <br />/s/ C.
