9~9 <br /> <br />__ _ _ ~_~_ _ . ~__ __ ___ _ _ ~~ _ __ T ____ <br />ORDINANCE N0. 8657 <br />An Ordinance vacating the following described area, to-wit: <br />That certain plaza knovrn as "Community Drive" commencing <br />at the intersection of the East line of Mi11~Street <br />with the North line of Tenth Avenue East, being thirty <br />(30} feet wide and entering a central drive seventy-four <br />(74} feet wide and known as "Community Drive" as platted <br />in Luckey Lane Subdivision of Eugene, ©regon and abutting <br />upon Lots 1, 2, 3 and 4 of said Subdivision. <br />~dHEREAS, heretofore and on the 12th day of August, 19.40, the Common Council <br />of the Citynof Eugene passed an Ordinance setting a hearing for the 23d day of <br />September, 1940, in the Council Chambers, at t~rhich time and place protests and <br />remonstrances could be heard as to the vacation of the following premises, to-wit: <br />That certain plaza known as "Community Drive" commencing <br />at the intersection of the East line' of Iviill Street <br />with the North line of Tenth Avenue East, being thirty <br />(30) feet wide and entering a central drive seventy-four <br />(74) feet wide and known as "Community Drive" as platted <br />in Luckey Lane Subdivision of Eugene, Oregon and abutting <br />upon Lots 1, 2, 3, and 4, of said Subdivision. <br />and, <br />WHEREAS, a heari,ag was held pursuant to said Ordinance in the Council <br />Chambers in the City Hall in the City of Eugene on Monday, the 23rd day of Sep~embe: <br />1940 at 7:30 o'clock P.M. and at said time the Council heard all objections, and <br />WHEREAS, all persons owning property abutting upon said street or drive <br />proposed'to be vacated have consented to said vacation and have applied for said <br />vacation, it being the purpose of said vacation to place a hospital upon Lots 1, <br />2, 3, and 4, of Luckey Lane Subdivision, Eugene, Oregon, which will rest upon not <br />only the lots but upon the Community Drive; now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLL01~,tS: <br />Section 1. The Common Council of the City of Eugene finds that due and <br />legal notice of said hearing was published and posted as required by law; that no <br />valid objection has been made at said hearing, or filed; that the consent of the <br />owners of the abutting property, properly acknowledged, has been filed in said <br />proceeding; and that the public interest will not be prejudiced by the vacation of <br />said street or drive. <br /> <br />Section 2. That said hearing was held on the 23rd day of September, 1940, <br />at 7:30 o'-clock p.m. in the Council Chambers of the City Hall in Eugene, Lane Count 1, <br />Oregon, and that all matters necessary to be done have been completed. <br />Section 3. That the following described area, to-wit: <br />That certain plaza known as "Community Drive" commencing at the <br />intersection of the East line of Mill Street with the <br />North line of Tenth Avenue East, being thirty (30) feet <br />wide and entering a central drive seventy-four (74) feet <br />wide and known as "Community Driven as platted in Luckey <br />Lane Subdivision of Eugene, Oregor~nd abutting upon <br />Lots 1, 2, 3, and 4, of said Subdivision. <br />be and the same is hereby vacated and the area so vacated, being a street or <br />drive shall revert to the abutting property pursuant to the statutes of the State <br />of Oregon. <br />Section 4, The Recorder be and he is hereby directed to file a certified <br />copy of this Ordinance with the Recorder of Lane County, Oregon, together with a <br />map or plat of said property, and that a certified copy of the Ordinance shall be <br />~i~$~x~i~ filed with the County Assessor and another certified copy of the <br />Ordinance shall be filed with the County Surveyor. <br />Passed by the Common Council <br />this 23rd day of September, 1940 <br />/s/ C.
