fit) 2 <br />ORDINANCE N0. 8659 <br />An Ordinance adopting the plans and specifications of the City Engineer <br />for the construction of a sewer, as follows: <br />Beginning at the main city sewer at the intersection of <br />24th Avenue East and Chula Vista Street, and running thence <br />east to a point approximately 20 feet East of the Wes± line of <br />Lot 1, Block 27, Chula Vista Park 2nd Addition, being a <br />6 inch main; and also three 4 inch laterals serving the proper- <br />ties located in Lots 1, 2 and 3, Block 27, Chula Vista Park <br />2nd Addition, all in the City of Eugene, Oregon; and <br />declaring an emergency. <br />WHEREAS, on the 14th day of October, 1940, the Common Council of the <br />City of Eugene passed Ordinance No. 8658 for the construction of a sewer as <br />described and set forth in the caption hereof, and <br />V~I-iEREAS, Section 3 of said Ordinance directed the City Engineer to make <br />plans and specifications for the construction of said sewer and file the <br />same with the City Recorder, and <br />V~"KEREAS, in accordance with such instructions the City Engineer has <br />prepared said plans and specifications and filed the same with the City Recorder- <br />of said City of Eugene on the 14th day of October, 1940, and the Common Council <br />of the City of Eugene, having examined and approved the same and being duly <br />advised in the premises, <br />TI-~~' CITY OF EUGETdE DOLS ORDAIN AS FOLLOViS: <br />.Section 1. That the plans and specifications of the City Engineer <br />for the construction of a sewer to be laid as follows: <br />Beginning at the main city sevrer at the intersection of <br />24th Avenue East and Chula Vista Street, and running <br />thence east to a point approximately 20 -feet East of <br />the West line of Lot 1, Block 27, Chula Vista i'ark 2nd Addition, <br />being a 6 inch main; and also three 4 inch laterals serving <br />the properties located in Lots I, 2, and 3, Block 27, Chula <br />Vista Park 2nd Addition, all in the City of Eugene, Oregon; <br />filed with the City Recorder on the loth day of October, 1940, be and the same <br />are in all things ratified, approved and adopted, and that said sewer be <br />constructed in accordance therewith. <br />Section 2. That the City Recorder be and he is hereby instructed to give <br />notice to contractors and to property ovrners as provided by the Charter of the <br />City of Eugene for the letting of contracts for the construction of sewers. <br />Section 3. That the Common Council of the City of Eugene does hereby <br />declare that the contract for the construction of said sevrer shall be let in one <br />contract and the City Recorder is hereby directed to state in the notice to <br />contractors and property owners that the contract for said improvement shall be <br />let as one contract. <br />Section 4. That the work on said improvement shall. commence within ten <br />days after the letting of ,the contract and shall be completed within thirty days <br />thereafter. <br />Section 5. The bidder receiving the contract for said improvement shall <br />execute a good and sufficient bond with one or more sureties to be approved by <br />the Street Committee in the sum of eighty per cent (80f) of the contract price, <br />for the faithful performance of the contract. <br />Section 6. Each person, firm, company or corporation bidding upon said <br />improvement shall accompany his bid~with a certified check in the sum of 5 per <br />cent of the amount bid as evidence of good faith and to guarantee the entering <br />into a contract in accordance with the bid submitted by him and the execution <br />of the bond herein provided for. <br />Section 7. Whereas, the improvement contemplated and provided for by <br />this ordinance is a necessary improvement and the sanitary condition of the <br />property is bad, the construction ~f said sewer is declared essential to the <br />Health and safety of the residents of said district, and it is therefore declared <br />that an emergency exists, and it is necessary for the preservation of the public <br />peace, health and safety that this ordinance take effect immediately upon its <br />passage by the Common Council and approval by the Mayor, <br />Passed by the Common Council Approved by the Mayor this <br />this 14th day of Oct. 1940 19th day of October, 1940 <br />/s/ C.
