X16 <br />ORDINANCE N0. 8669 <br />An Ordinance initiating the vacation of the following described <br />premises, to-wit: <br />The alley running North and South through <br />Block 9, Fairmount Addition to Eugene, lane <br />County, Oregon <br />and calling a hearing and directing th~~.t notice be given <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority witriout petition or censent of the <br />property owners, excepting as provided by statute, of the following described <br />property, to-wit: <br />The alley running North and South through <br />Block 9, Fairmount Addition to Eugene, Lane <br />County, Oregon <br />Section 2. A hearing shall be held upon the proposal to vacate the alley <br />as herein provided, and said hearing shall be had on the 10th day of February, <br />1941, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 o'clock <br />p.m. of said day, at which time all persons will be heard upon objections or <br />suggestions with reference to the vacation of said alley, and at sa~,d time the <br />Council will provide for the vacation of said premises or deny such vacation, and <br />in case the vacation is made, will make provisions for any damages sustained, by <br />local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane County, <br />Oregon, the newspaper selected by him is hereby designated as the official newspaper <br />of the city for this purpose, notice of the proposed vacation. Such notice shall ~~ <br />give the description of the area to be vacated as herein set out, and state the <br />date when this ordinance was passed; the name of any petitioners petitioning for ~I <br />said vacation; the date when the said petition, together with any objection or <br />remonstrances which may be made in writing and filed v:~ith the City Recorder <br />prior to the date of said hearing, wild. be heard and considered. i <br />Section 4. The City Recorder shall forthvrith and within five days after `1 <br />the first publication of said notice, post or cause to be posted at or near ij <br />each end of said proposed vacation, a copy of the foregoing notice which shall be ~I <br />headed "NOTICE OF ALLEY VACATION", and which notice shall be posted in at least ~ <br />two conspicuous places in such proposed vacation of such area. ' <br />The posting and the first day of publication of such notice shall be not <br />less than ttiventy-eight days before the time set for hearing. <br />Section 5. Whereas,, the State Highway Commission has acquired for state <br />highway purposes an area of land in a portion of the city where tYie streets and <br />alleys are unused and are developing a property for a highvuay base business <br />property, and it is necessary and desirable tYlat the alley may be vacated in order <br />that tYie entire area may be devoted to the single use contemplated by the State <br />Highway Comrriission, and an emergency is hereby declared to be necessary for the <br />imt~~ediate preservation of the peace, health and safety of the City of Eugene <br />this ordinance take effect immeidately upon its passage by the Common Council and <br />its approval by the Iviayor, and it is so ordered. <br />Passed by the Common Council <br />this 23rd day of December, 1940 <br />C .
