11`7 <br />ORDINANCE N0. 8670 <br />An ordinance providing for exclusive parking at the entrance of each <br />residence upon application of the otivner or occupant. <br />~~^~FEAS, an abuse has arisen in the city of Eugene in that the occupants <br />of many residence properties are excluded from entrance and exit from their own <br />property by reason of automobiles being parked solidly around their properties, <br />making it impossible for them to park their cars at the residence entrance. <br />TriE CITY OF EUGETv~'E DOES ORDAIN AS FOLLOZ'µS: <br />Section 1. Any owner, lessee or occupant of residential property used <br />as such in the City of Eugene may make application to the City Engineer for an <br />exclusive parking space in front of the sidewalk entrance to their residence <br />(other than the driveway}, accompanying said application with a deposit of a Two <br />Dollar 02.00) fee and such inf ormation as the City Engineer's office requires <br />for a convenient record. <br />Section 2. Upon receipt of such application and payment of the fee the <br />City Engineer shall forthwith cause to be painted•a yellow parking space of con- <br />venient width and twenty feet in length in the street opposite the sidewalk <br />entrance to the residence, which parking space may be marked with any convenient <br />legend, such as "RESERVED" or "NO PARKING", and such parking space shall thence <br />forth during the calendar year be deemed the exclusive parking space servicing <br />said residence. <br />Section 3. The reserved parking space may be renewed from year to year <br />by the payment of Two Dollars 02.00) for each year's reservation at the office <br />of the City Engineer, together with any further application or information re- <br />quired by the Engineer's office. <br />Section 4. It shall be unlawful within the City of Eugene for any owner <br />or driver of an automobile to park the same within such reserved residential <br />parking space without the consent of the owner or lessee. <br />Section 5. Police officers as far as is reasonably possible shall them- <br />selves enforce this ordinance and any occupant of a residence may file a complaint <br />against the owner of the offending automobile. <br />Section 6. Any person, firm or torpor°ation violating any of the pro- _ <br />visions of this ordinance s~~all, upon conviction thereof before the City Recorder, <br />be liable to a fine of not less than One Dollar (~p1.00) and not more than <br />Twenty-f ive ( 25.00 } , and in default of payment th ereof may be imprisoned in the <br />city jail for one day for each Two dollars 02.00) of the fine unpaid. <br />Section 7. Whereas, complaints are being made by residents of the city <br />that they are wholly excluded from their own premises by reason of persons parking <br />solidly in front of them and-that the situation is such that it constitutes a <br />menace and element of danger in the use of automobiles in the city, <br />Therefore, an emergency is declared to exist and it is declared to be <br />necessary for the immediate preservation of the peace, health and safety of the <br />City of Eugene that this ordinance take effect immediately upon its passage by the <br />Common Council and its approval by the Mayor, and it is so ordered. <br />Passed by the Con~on Council <br />this 13th day of Januar y, 1941. <br />C.
