The Common Council of the City of Eugene hereby initiates vacation. proceedings on its own authority without petition or consent of the property owners, excepting as provided by statute, of the following described street, ito-wit: I 24th Avenue between Lincoln Street and Charnelton .Street; 24th Avenue between Charnelton S reet and Olive Street, all in College Hill Park Addition to the C~ty of Eugene, Lane County, Oregon. .Section 2. A hearing shall be held upon the proposal to vacate the street as herein provided, and said hearing shall be had on the 28fih day of April, 1941, at the Council. Chambers in the City Hall in Eugene, Qregon, at 7:30 o'clock P.M. of said day, at which time all persons will be heard upon objections or suggestions with reference to the vacation of said street, and at said time the Council will provide for the vacation is made will make provisions for any damages sustained, by local assessment. Ij Section 3. The City Recorder be and he is hereby required to immediately --~ !publish for four consecutive weeks in a newspaper published in Eugene, Lane ~'~County, Oregon, the newspaper selected by him is hereby designated as the official newspaper of the city for this purpose, notice of the proposed vacation. f~Such notice shall give the description of the. area to be vacated as herein set out, ,and Mate the date vahen this ordinance was passed; the name of any peti- ~tioners petitioning for said vacation; the date ~;:heri the said petition, to- ~gether with any objection or remonstrances which ma3r be made in writing and filed with the City Recorder prior to the date of said hearing, will be hoard and considered. Section 4. The City Recorder shall forthwith anc~~~-within five days after the first publication of said nctice, post or cause to be posted at or near each nd of said proposed vacation, a copy of the foregoing notice which shall be ended "NOTICE OF STREET VACATION", and which notice shall be posted in at east two conspicuous places in such proposed vacation of such area. The posting and the first day of }ublication of such notice shall be not ess than twenty-eight days before thc. time set for hearing. Section 5. Whereas, the ~rotions of 24th Avenue sought to be vacated rest n the side of a steep declivity and are not suitable for roadway purposes and f improved, would constitute a traffic hazard and constitute a hazard as they ow stand unimpmoved, laid out as a street or roadway and the city incurs iability for the street and it is not susceptible to practical improvement and onstitutes a menace and a dangerous area for the city to take responsibility or.
