<br />1~1 <br />OF.DINti.NCE N0. 8673 <br />An Ordinance initiating the vacation of the following described street, <br />to-wit: <br />24th Avenue between Lincoln Street and Charnelton Street; 24th <br />Avenue between Charnelton Street and Olive Street, all in College <br />Hill Park Addition to the City of Eugene, Lane County, Oregon. <br />,and calling a hearing and directing that notice be given. <br />1 <br />THE CITY OF EUGER~' DOES GPD.tiIN AS FOI,I,OWS: <br />' Section 1. The Common Council of the City of Eugene hereby initiates vacation. <br />proceedings on its own authority without petition or consent of the property <br />owners, excepting as provided by statute, of the following described street, <br />ito-wit: <br />I <br />24th Avenue between Lincoln Street and Charnelton .Street; 24th <br />Avenue between Charnelton S reet and Olive Street, all in College <br />Hill Park Addition to the C~ty of Eugene, Lane County, Oregon. <br />.Section 2. A hearing shall be held upon the proposal to vacate the street <br />as herein provided, and said hearing shall be had on the 28fih day of April, <br />1941, at the Council. Chambers in the City Hall in Eugene, Qregon, at 7:30 <br />o'clock P.M. of said day, at which time all persons will be heard upon objections <br />or suggestions with reference to the vacation of said street, and at said time <br />the Council will provide for the vacation is made will make provisions for any <br />damages sustained, by local assessment. <br />Ij Section 3. The City Recorder be and he is hereby required to immediately <br />--~ !publish for four consecutive weeks in a newspaper published in Eugene, Lane <br />~'~County, Oregon, the newspaper selected by him is hereby designated as the <br />official newspaper of the city for this purpose, notice of the proposed vacation. <br />f~Such notice shall give the description of the. area to be vacated as herein set <br />out, ,and Mate the date vahen this ordinance was passed; the name of any peti- <br />~tioners petitioning for said vacation; the date ~;:heri the said petition, to- <br />~gether with any objection or remonstrances which ma3r be made in writing and filed <br />with the City Recorder prior to the date of said hearing, will be hoard and <br />considered. <br />Section 4. The City Recorder shall forthwith anc~~~-within five days after the <br />first publication of said nctice, post or cause to be posted at or near each <br />nd of said proposed vacation, a copy of the foregoing notice which shall be <br />ended "NOTICE OF STREET VACATION", and which notice shall be posted in at <br />east two conspicuous places in such proposed vacation of such area. <br />The posting and the first day of }ublication of such notice shall be not <br />ess than twenty-eight days before thc. time set for hearing. <br />Section 5. Whereas, the ~rotions of 24th Avenue sought to be vacated rest <br />n the side of a steep declivity and are not suitable for roadway purposes and <br />f improved, would constitute a traffic hazard and constitute a hazard as they <br />ow stand unimpmoved, laid out as a street or roadway and the city incurs <br />iability for the street and it is not susceptible to practical improvement and <br />onstitutes a menace and a dangerous area for the city to take responsibility <br />or. That it is to the interest of the city that the same be vacated and no <br />onger be regarded as a roadway or artery, and an emergency is hereby declared <br />o exist and it is declared to be necessary for the immediate preservation <br />f the peace,. health and safety of the city of Eugene that this ordinance take <br />ffeet immediately upon its passage by the Common Council and its approval by <br />he Mayor, 'and it is so ordered. <br />~~ <br />asSed by the Common~~.Council Approved by the Mayor this <br />this 10th day of March, 1941. 11th day of March, 1941. <br />_ C.~JI.
