I <br />122 <br />ORDINANCE N0. 8674 <br />o <br />An Ordinance vacating the following described street, to-wit; <br />24th A~aenue between Lincoln Street and Charnelton Street; 24th <br />Avenue between Charnelton Street and Olive Street, all in College <br />Hill Park Addition to the City of Eugene, Lane County, Oregon. <br />1~'4~tEAS, heretofore and on the 10th day of March, 1941, the Common Council <br />of the City of Eugene passed an Ordinance setting a hearing for the 28th day of <br />April, 1941 in the Council Chambers, at vahich time and place protests and <br />remonstrandes could be heard as to the vacation of the following described street: <br />24th Avenue between Lincoln Street and Charnelton Street; 24th <br />Avenue between Charnelton Street and Olive Street, all in College <br />Hill Park Addition to the City of Eugene, Lane County, Oregon. <br />and, <br />VdHEPEAS, a hearing was held pursuant to said Ordinance in the Council <br />.Chambers in the City Hall in the City of Eugene on Monday, the 28th day of April, <br />1941 at 7:30 o'clock P.M. and at said time the Council heard all objedtions, and <br />tiSr~REAS, all persons owning property abutting upon said street proposed to <br />vacated have consented to said vacation and have applied for said vacation. That <br />the portions of 24th Avenue sought to be vacated rest on the side of a steep <br />declivity and are not suitable for roadway purposes and if improved, would consti- <br />tute a traffic hazard and constitute a hazard as they now stand unimproved, laid <br />out as a street or roadway and the city incurs liability for the street and it is <br />not susceptible to- practical improvement and constitutes a menace and a dangerous <br />area for the city to take responsibility for. That it is to the interest of the <br />city that the same b.e vacated and no longer be regarded as a roadway or artery. <br />THE CITY OF EUGENE DOES ORDIyIN AS FOLLOV'vS: <br />Section 1. The Common Council of the City of Eugene finds that due and <br />legal notice of said hearing was published and posted as required by law; that no <br />valid objections has been made at said hearing, or filed; that the consent of the <br />owners of the abutting property, properly acknowledged, has been filed in said <br />proceeding; and that the public interest vc~ill not be prejudiced by the vacation <br />of said portions of street. <br />Section 2. That said hearing was held on the 28th day of April, 1941 <br />at 7:30 o'clock P.N1. in the Council Chambers of the City Hall in Eugene, Lane <br />County, Oregon, and that all matters necessary to be done have been completed. <br />Section 3. That•the following described street, to-v~~it: <br />24th Avenue between Lincoln_Street and Charnelton Street; 24th <br />Avenue between Charnelton S{reet and Olive Street., all in College <br />_' ~- _~ ~:Hi13t~.Park~-:Addit~ion~`to;-th~ Ofi~y~~o~' Eugen~;~~4L~ne County, Oregon. <br />be and the same is hereby vacated and the street so vacated, being pa~rtions of <br />24th Avenue West, shall revert to the abutting property pursuant to the statutes <br />of the State of Oregon; reserving, hovaever, to the City of Eugene the perpetual <br />right to maintain any public utilities or structures now in the street and to <br />lay down at any time that the Council deems necessary or convenient any public <br />utility in the street, and reser-vin~ the right to enter upon the street and <br />maintain the same. <br />Section 4.
