I <br />1~ 4~ <br />I <br />I ORDINANCE N0. 8676 <br />I <br />An Ordinance inita.ating the vacation of the following described premi- <br />ses, to-wit; <br />The alley running East from Olive S'~r•eet, between <br />2~rd and 24;.th Streets in Block 3, Rugh's Addition <br />to Eugene, Lane County, Oregon. <br />and calling a hearing and directing that notice be given. <br />I TII~ CITY OF EUGENE DOES ORDAIN AS FOLLO'~'47S: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority ~eithout petition or consent of the <br />property ovaners, excepting as provided by statute, of the following described <br />property, to-v~~it: <br />~ The alley running East from Olive Street, between <br />23rd and. 24th Streets in Block 3, Rugh's Addition <br />~ to Eugene, Lane County, Oregon. <br />Section 2. A hearing shall be held upon the ~~roposal to vacate the <br />alley as herein provided, and said hearing shall be had on the 23rd day of <br />June, 1941, at the Council Chambers in the City Hall in Eugene, Oregon, at <br />7:30 o'clock P.M. of said day, at v,~~~ich time all persons will be heard upon <br />objections or suggestions with reference to the vacation of said alley, and <br />at said time the Council will provide for the vacation of said premises or <br />deny such vacation, and in case the vacation is made vaill ~a~e provisions <br />for any damages sustained, by local assessment. • <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a ne~~~spaper I:ublished in Eugene, Lane <br />County, Oregon, the newspaper selected by him is hereby designated as the <br />official newspaper of~the city for this purpose, notice of the proposed <br />vacation. Such notice shall give the description of the area to be vacated <br />as herein set out, and state the date when this ordinance was passed; the <br />name of any petitioners petitioning for said vacation; the date when the said <br />petition, togetrier with any objection or remonstrances vahich may be made in <br />writing and filed with the City Recorder prior to the date of s~.id hearing, <br />will be heard and considered. <br />Section 4. The City Recorder shall forthwith and within five dayTs after <br />the first publication of s~:id notice, post or cause to be posted at or near <br />each end of said proposed vacation, a copy of the foregoing notice w:~ich shall <br />be headed nNotice of Alley Vacation", and ~^ahich notice shall be posted in <br />at least two conspicuous places in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be <br />not less than twenty-eight days before the time set for hearing. <br />Section 5. ~~hereas the alley sought to be vacated is upon the <br />precipitous incline running from Olive Street Easterly and constitutes a <br />dangerous and difficult tYioroughfare v~~ithout any outlet and the city incurs a <br />risk by keeping the same open to public travel, an emergency is hereby de- <br />clared to exist and it is declared to be necessary for the immediate pre- <br />servation of the peace, health and safety of the city of Eugene that this <br />ordinance take effect immediatley upon its passage by the Common Council and <br />its approval by the Mayor, and it is so ordered. <br />Passed by the Common Council <br />this 12th day of May, 1941. <br />John Fields <br />City Recorder Pro-Tem <br />Approved by the Mayor this <br />13th day of May, 1941. <br />Elisha Large <br />Mayor <br />
