I <br />12s <br />ORDINANCE N0. 8678 <br />to-wit: <br />An Ordinance initiating the vacation of the following described premises, <br />All of that portion of the alley in Block 2 of Ramble Addition <br />to Eugene lying east and south of the extension of the north <br />line of Lot 10, Block 2 across the alley, all in Lane County, <br />Oregon. <br />and calling a hewing and directing that notice be given. <br />THE CITY OF EUGENE DOES OFDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority without petition or consent of .the <br />property otivners, excepting as provided by statute, of .'the following described <br />property, to-wit; <br />All of that portion of the alley in Block 2 of Ramble Addition <br />to Eugene lying east and south of the extension of the north <br />line of Lot 10, Block 2 across the alley, all in Lane County, <br />Oregon. <br />Section 2. A hearing shall be held upon the proposal to vacate the <br />portion of the alley as herein provided and said hearing shall be had on the <br />14th day of July, 1941, at the Council chambers in the City Hall in Eugene, <br />Oregon, at 7:30 o'clock P.M. of said day, at which time all persons~vaill be <br />heard upon objections or suggestions with reference to the vacation of said <br />portion of alley, and said time the Council will provide for the vacation of <br />said premises or deny such vacation, and in case .the vacation is made will'~~~r~ <br />make provisions for any damages sustained, by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four co~isecutive weeks in a newspaper published in Eugene, Lane <br />County, Oregon, the newspaper selected by him is hereby designated as the off- <br />icial newspaper of the city for this purpose, notice of the proposed vacation. <br />Such notice shall give the description of the area to be vacated as herein <br />set out, and state the date when this ordinance was passed; the name of any <br />petitioners petitioning for said vacation; the date v:~hen the said petition, <br />together with any objection or remonstrances which may be made in writing and <br />filed with the City Recorder prior to the date of said hearing, will be heard <br />and considered. <br />Section 4. The City Recorder shall forth~~ith and within five days of ter <br />the first publication of said notice, post or cause to be posted at or near <br />each end of said proposed vacation, a copy of the foregoing notice which shall <br />be headed "NOTICE OF ALLEY VACATION", and which notice shall be posted in at <br />least two conspicuous places in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be <br />not less than twenty-eight days bef ore the time set for hearing. <br />Section 5. Whereas, the portion of the alley sought to be vacated is on <br />a hillside in a draw where it is most difficult to improve and is a blind alley <br />having no outlet and is so used as to be dangerous for use and liable to in- <br />volve the city in damage claims, and an emergency is hereby declared to exist <br />and it is declared to be necessary go the immediate preservation of the peace, <br />health and safety of the city of Eugene that this ordinance take effect imme- <br />diately upon its passage by the Common Council and its approval. by the Mayor, <br />and it is so ordered. <br />Passed by the Common Council <br />this 26th day of May, 1941. <br />John Fields <br />ity Recorder Pro-Tem <br />Approved by the Mayor this <br />27th day of May, 1941. <br />Elisha Large <br />Mayor <br />
