I <br />~~ <br />ORDINANCE NO. 8685 <br />An Ordinance amending Section Thirteen of the Ordinance Number 8413 <br />entitled, <br />"An Ordinance to create or divide the City into Districts <br />within some of which it shall be lawful, and within others <br />of wh ich it shall be unlawful to erect, construct, alter <br />or maintain certain buildings, or to carry on certain trades <br />or callings, or within which the height and bulk of future <br />buildings shall be limited, and providing for setback lines, <br />and providing for a penalty for the violation thereof." <br />passed by the Common Council ~'pril 8, 1935 and approved by the TVlayor April 9, <br />1935, by extending the provision as to setback lines. <br />THE CITY OF EUGETTE DOES ORDAIN AS FOLLOti"3S: <br />Section 1. That section 13 of Ordinance No. 8413 entitled, <br />"An Ordinance to create or divide the City into Districts <br />within some of which it shall be lawful, and within others <br />of which it shall be unlawful to erect, construct, alter <br />or maintain certain buildings, or to carry on certain trades <br />or callings, or within which the height and bulk of future <br />buildings shall be limited, and providing for setback lines, <br />and providing for a penalty for the violation thereof." <br />passed by the Common Council April 8, 1935 and approved by the Mayor April 9, <br />1935, be and the same is hereby amended to read so as to add the following.; <br />"Setback lines are hereby established upon Seventh Avenue <br />from the western city limits to its junction with Pearl <br />Street of sixteen feet on each side of Seventh Avenue and <br />no building or structure shall be permitted nearer to said <br />street than as herein provided except that the common <br />council may upon application of a property owner by special _.. <br />.ordinance change or alter the setback line as to a <br />particular property. <br />"Setback lines are hereby established upon Sixth tivenue <br />from the western city limits to its junction with High <br />Street of sixteen feet on each side of Sixth Street <br />and no building or structure shall be permitted nearer <br />to said street than as herein provided except that the <br />common council may upon application of a property owner <br />by special ordinance change or alter the setback line <br />as to a particular property." <br />The City Engineer be andhe is hereby authorized and directed to place the <br />foregoing setback lines upon the Use Map of the City of Eugene and immediately <br />draft such line upon the Use District Map and the said lines bg~ and they are <br />hereby established as the setback lines between said terminals of Sixth Street <br />j and Seventh Street in the City of Eugene. <br />Section 2.
