~s9 <br />ORDINANCE N0. 8714 <br />An Ordina nce regulating auctioneers in the City of Eugene requiring <br />a license, and imposing a penalty for violations thereof, and repealing all <br />former auctioneer license ordinances. <br />THE CITY OF EUGENE DOES ORDAIP~ AS FCLL0I~~FS: <br />Section 1. Ever-y person shall be deemed an auctioneer within the ~ <br />I <br />meaning of this ordinance, whose business it is to offer property for sale at ~ <br />public outcry. <br />Section 2. No person, firm or corporation shall conduct an auction <br />sale or act as auctioneer. vaithin the City of Eugene without fiz•st obtaining a <br />license therefor. <br />Section 3. Auctioneers shall be divided into four classes, <br />designated first, second, thin'd, and fourth class respectively. <br />Section 4. Auctioneers of the first class shall be those who carry <br />on their business at a designated place, which shall be known and advertised as <br />an auction house only, which place shall be specified in their license; and <br />auctioneers of tiie first class shall autornatically be qualified to act as <br />auctioneers of the fourth class without further license. First class <br />auctioneers shall pay a license fee of Sixty dollars per annum, payable each <br />four months in advance, January first, l~~iay first, and September first. <br />Section 5. Auctioneers oz' tYie second class shall be those v~Tho sell <br />at auction to merchants or dealers only, and those tivYio conduct temporary auction <br />sales of gold, silver, plated ware, precious stones, watches, or jewelry, or <br />bankrupt, or damaged stocks of general merchandize, whether the same shall be <br />their own property, or whether they sell the same as agents or employees of <br />others, and all such sales above rientioned shall be deemed and defined to be <br />temporary if they consist of stocks brought to this city and so offered witYiin <br />one year of their arrival, or L.--hen the part' conducting the sale cannot give <br />satisfactory evidence to the contrary, provided that this section shall not <br />apply to judicial sales, or to public sales by guardians, executors, or <br />adrnirlistrators; nor• to merchants desiring to close out their stocks, where the <br />same has been kept as a continuous stock for• sale in the City of Eugene for one <br />year or• more, but such ov~ner or the auctioneer selling the stock shall come under <br />the third class. Second .class licenses strall be Twenty dollars per day or <br />Seventy five dollars per week. <br />Section 6. Auctioneers of the third class shall be tYiose sales of <br />merchants desiring to close out their stocks, where the same ras been kept as <br />a continuous stork for sale in the City of Y1'ugene for one year or• more and such <br />owner or auctioneer shall. be required to pay Ten dollars per day or Thirty seven <br />and 50100 Dollars per week:for a license to conduct a sale of the third class. <br /> <br />I <br />
