193. <br />ORDINANCE N0. 8748 <br />An Ordinance amending Section 2. of Ordinance No. 8612 entitled, "An <br />Ordinance to prohibit the sale and use of fire crackers, sky rockets, torpedos, <br />bombs, cap pistols and other similar explosives, or the sale or use of confetti, <br />and providing a penalty for the violation thereof." passed by the Common Council <br />on the 24th day of July, 1939 and approved by the Mayor on the 25th day of July, <br />19 39 . <br />Vt'HEREAS, the United States is now at war and the United States Congress <br />has passed a Federal Statute that nose of the ordinary implements or explosives <br />common to the Fourth of July should be sold or• permitted to be used at any time <br />or under any circumstances, and the City of Eugene desires to conform to the <br />National Law in that respect, and therefore, <br />THE CTTY OF EUGENE DOES ORDAIN AS FOLLO~,'~S: <br />Section 1. That Section Two of Ordinance No. 8612 entitled ~'An Ordinance <br />to prohibit the sale and use of fire crackers, sky rockets, torpedos, bombs, <br />cap pistols and other similar explosives or the sale or use of confetti, and <br />providing a penalty for the violation thereof," passed by the Common Council on <br />the 24th day of July 1939, and approved by the Mayor on the 25th day of July, <br />1939, be and the same is hereby amended to read as follows: <br />TMIt shall be unlawful for any person or persons, firm or corporation <br />within the City of Eugene to sell, offer for sale, give away or in any <br />other manner dispose of, or to use, fire, explode or discharge in any <br />manner whatever, any fire crackers, sky rockets, torpedos, bombs, cap <br />pistols or any similar implement or explosive at any place in the City; <br />or to sell or use conf etti in public places." <br />Seetion 2. ~~REAS the Congress of the United States has passed a Federal <br />Statute prohibiting the use of any of the explosives ordinarily used on the Fourr~h <br />of July or of any of the implements used therefor, therefore an emergency is <br />declared to exist and it is hereby declared to be necessary for the preservation <br />of the peace, helath, and safety of the City of Eugene that this Ordinance <br />take effect immediately upon its passage by the Common Council and approval by <br />the Mayor, and it is so ordered. <br />Passed by the Common Council <br />this _,__.e___ day of June, 1942 <br />/s/ John Fields <br />City Recorder Pro Tem <br />Approved by the Mayor this <br />day of June, 1942. <br />/s/.
