<br />~~~ <br />Ordinance No. 8766 <br />An Ordinance amending Ordinance No. 8764 entitled "An Ordinance prohibiting <br />dogs from running at large during the months of April, May, June, July, August, <br />and September of any year in the City of Eugene, declaring an emergency and <br />providing penalties," passed by the Common Council on the 22nd day of NTarch, 1943 <br />and approved by the Mayor on the 23rd day of NTarch, 1943. <br />TIC CITY OF EUGENE DOES ORDAIN AS FOLLO~~JS: <br />Section 1. That Ordinance No. 8764 entitled "An Ordinance prohibiting <br />dogs from running at large during the months of April, Tray, June, July, August, <br />and September of any year in the City ,of Eugene, declaring an emergency and <br />providing penalties," passed by the Comrrion Council on the 22nd day of March, 1943 <br />and approved by the TvTayor on the 23rd day of March 1943 be amended so that <br />Section 6 thereof shall read as follows: <br />"Section 6. An officer impounding a dog shall report to the., Police Department <br />upon a slip to be furnished, a description of the dog impounded giving the <br />size, color, weight, sex, breed and apparent age and his license number, <br />if any. The Chief of Police shall cause notice to be given the owner of <br />the dog if known or disclosed by the license, by mails and shall cause a <br />notice to be published once in tYie Eugene Register-Guard describing dogs so <br />impounded and notifying the ov4ner or ownez~s to immediately call for said dog, <br />pa,y the costs of impounding, procure a license if the dog has none, and <br />give the Chief of Police reasonable assurances that the dog will not again <br />run at large. Upon compliance by the owner, the Chief of Police shall direct <br />that the dog be released to his owner, and the owner exonerated." <br />And that Ordinance TV'o. 8764 be further amended so that Section 10 thereof shall <br />read as follows: <br />"Section 10. Any person, firm or corpmatian violating any of the provisions <br />of this ordinance shall upon conviction thereof in the Recorder's Court be <br />fined not to exceed :10.00 and the costs of the prosecution and upon default <br />in payment of the fine, may be imprisoned in the City Jail one day for each <br />X2.00 of such fine unpaid." <br />And that it be further amended by adding thereto section 102 reading as follows: <br />"Section 102. That the Counci_1 hereby declares that dogs running at large <br />during the garden season, polluting streets and vegetation and trespassing <br />upon private property is hez°eby declared to be insanitary, a threat to <br />public health, and a public nuisance." <br />Section 2.
