I <br />~~~ <br />ORDINANCE N0. 8778 <br />An Ordinance prohibiting all persons under sixteen years of age from <br />being on the streets, alleys and other public places in the City of Eugene, <br />after certain hours at night, and fixing a penalty. <br />THE CITY OF EUGENE DOES ORDAIA? AS FOLLOWS; <br />Section 1. It is hereby made unlawful for any person under the age <br />of sixteen years to be in or remain in or upon any of the streets, alleys, <br />or other public places in the City of Eugene, at night after the hour of <br />ten (10;00) o'clock P.Mi; unless such person is accompanied by a parent, <br />guardian or other person having the care and custody of such minor person; <br />or whose employment makes it necessary to be in or upon such street, alley <br />or other public places during the night time after such specified hour. <br />Section 2. It is hereby made unlawful for any parent, guardian or <br />other person having the legal care and custody of any such child, ward or <br />other person, under such age, while in such legal custody, to go or be in <br />or upon any such street, alley or other public place within the time <br />prohibited in Section 1 of this Ordinance unless there exists a reasonable <br />necessity therefor. <br />Section 3. Any police officer is hereby authorized to arrest any <br />person or persons fiaiolating any of the provisions under this ordinance. <br />The person or persons so arrested shall, for the first violation of the <br />ordinance, be taken or sent by the o~:ficer to his home and his or their <br />parents or guardian notified of such violation of this ordinance; Upon a <br />second violation of the provisions of this ordinance the person or persons <br />so arrested shall be held by the Police officers at the City Hall and his <br />or their parents or guardians notified of such violation of this ordinance <br />and directed to come in person and conduct the person arrested home; Upon <br />a third violation of the provisions of this ordinance the person or persons <br />so arrested shall be taken or sent home by the officer and a complaint filed <br />against such parents or guardians for a violation of this ordinance. <br />Section 4. Upon a conviction for a violation of this ordinance before <br />the City Recorder, the parent or guardian so convicted shall be fined not to <br />exceed ~20.OO,Taiid may be imprisoned in the City ~dil not to exceed one day <br />for each 2.00 of the fine unpaid. <br />Section 5. It shall be the duty of any police officer arresting <br />such child or minor person, if the child or minor person has no home or <br />guardians or refuses to give the name and address of such home or parent <br />or guardian, to place such child or minor person in charge of the Juvenile <br />Cout of Lane County, Oregon. <br />All due diligence shall be used by the officer so arresting such <br />person to find the parents or guardian responisbile for such minor person. <br />Section 6.
