Section 2. The herein above-described portions of street rights-of-way are hereby vacated and the portions of street rights-of-way so vacated shall revert pursuant to the statutes of the State of Oregon. Section 3. Notwithstanding the provisions of the Eugene Charter of 1976 as to the effective date of ordinances, this Ordinance shall not become effective until after (a) petitioner has submitted to City a replat of the West Park Commercial Centre Subdivision that provides sufficient right-of- way, including street and utility improvements, for relocation of Commerce Street between West 11 th Avenue and West 13th Avenue; (b) the City has approved the replat and the replat has been recorded with the Recorder of Lane County; and (c) the Eugene Water and Electric Board has notified City that petitioner has made satisfactory arrangements to pay all of the costs associated with moving utilities necessitated by the street vacation. Section 4. Upon the effective date as provided in Section 3 above, the City Recorder is hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor. Section 5. If the replat is not approved and recorded within two years from the date of adoption of this Ordinance, then this Ordinance automatically shall be repealed unless the Council extends the two-year period by amending the Ordinance.
