<br />corporation and formally recognized community organization ("ICCO") and the City of <br /> <br /> <br />Eugene (CITY), an Oregon Municipal corporation entered.into an agreement to develop <br /> <br /> <br />a plan to provide a wastewater collection system and implement an annexation program <br /> <br />for properties within the Highway 99 North Industrial Corridor area. <br /> <br /> <br />The Annexation and Urban Services Policy Agreement stipulates that both <br /> <br /> <br />developed and undeveloped properties outside the City limits and within the Urban Growth <br /> <br /> <br />boundary of the Highway 99 North industrial area will have to submit a delay of effective <br /> <br /> <br />date annexation agreement to the City of Eugene to connect to the wastewater system. <br /> <br /> <br />Only properties requesting services have been included in the proposed local improvement <br /> <br /> <br />district. All properties requesting service from the proposed sewer have submitted an <br /> <br /> <br />annexation agreement. <br /> <br />C. The City Council's determination to construct sanitary sewers and form local <br /> <br /> <br />improvement districts to assess the property specially benefitted by the construction of a <br /> <br />sanitary sewer is a discretionary act based upon the Council's assessment of what is <br /> <br /> <br />necessary or essential for the public good. <br /> <br />D. The City Engineer's report and Hearings Official's minutes, findings and <br /> <br /> <br />recommendations presented to the City Council in conjunction with this matter and this <br /> <br /> <br />Resolution ratify past decisions of the City Council regarding initiating the formation of the <br /> <br /> <br />local improvement district and satisfy the requirement of Section 7.160 of the Eugene <br /> <br /> <br />Code, 1971 (EC). <br /> <br />E.
