<br />necessary or essential for the public good. <br /> <br />E. Because the groundwater in the Santa Clara area shows contamination by <br />private septic systems, because of the limitation on further development in the Santa Clara <br />area imposed by the Environmental Quality Commission, and because the public has <br />already spent approximately $38 million to construct sanitary sewerage facilities to serve <br />the River Road and Santa Clara areas and must now fulfill its contractual obligations to the <br />U. S. Environmental Protection Agency to make sanitary sewers available to the existing <br />structures with plumbing fixtures, the City Council deems it necessary and essential that <br />it now form local improvement districts to assess the cost of constructing the sanitary <br />sewer system and to allow specially benefitted property to connect to the system when the <br />connections are consistent with the provisions of the Metropolitan Area General Plan. <br />F. At this time in order to avoid the premature development of vacant property in <br />the Santa Clara area, the parcels of real property that are improved with structures having <br />plumbing fixtures or developed with or only capable of being developed with adjacent <br />properties under the same ownership shall be included within the local improvement <br />district. Property encumbered with right-of-way used for roads, drainage, or other <br />restrictions that prevent development of the property shall not be deemed to be benefited. <br />G. On November 20, 1989, and in each fiscal year thereafter, sanitary sewer <br />construction projects within the River Road and Santa Clara area basins were included in <br />the Council approved CIP.
