ADMINISTRATIVE RULE R-8.005 <br />REGULATIONS FOR ADMINISTRATION AND ENFORCEMENT OF THE <br />BUILDING, FIRE AND OTHER TECHNICAL CODES <br />R -8.005-A GENERAL. <br />1. Scope. <br />1.1 Administrative Rules. These regulations shall govern the administration <br />and enforcement of the administrative, building, fire and other technical codes adopted <br />pursuant to Chapter 8 of the Eugene Code, 1971. <br />1.2 Technical Codes. The technical codes adopted pursuant to Chapter 8 of <br />the Eugene Code, 1971, shall have the following scope: <br />1.2.1 Electrical Code. The electrical code and all regulations concerning <br />the application of the electrical code shall apply to installations of electrical <br />conductors and equipment within or on public and private buildings or other <br />structures, including mobile homes, recreational, vehicles and floating buildings, <br />other premises such as yards, carnivals, parking and other lots, and industrial <br />substations; installations of conductors that connect to the supply of electricity; <br />installations of other outside conductors on the premises; and installations of optical <br />fiber cable. <br />1.2.2 One and Two Family Dwelling Code. The one and two family <br />dwelling code and all regulations concerning the application of the one and two <br />family dwelling code shall apply to the construction, prefabrication, alteration, <br />repair, use, occupancy and maintenance of detached one- or two-family dwellings <br />not more than three stories in height, and their accessory structures, including <br />structures classified as R-3, M-1 and M-2 occupancies as defined in the structural <br />specialty code and to residences used for family day care in accordance with ORS <br />418.820 and OAR 412-10-700. <br />1.2.3 Fire Code. The fire code and all regulations concerning the <br />application of the fire code shall apply to all persons, unless specifically exempted <br />by federal or state law or local ordinance, and to existing conditions as well as to <br />conditions arising after the adoption of the fire code, except that conditions legally <br />in existence at the adoption of the fire code and not in strict compliance therewith <br />shall be permitted to continue only if, in the opinion of the Fire Marshal, they do <br />not constitute a distinct hazard to life or property. Where no applicable standards <br />or requirements are set out in the fire code, or contained within other statutes, codes <br />or administrative rules, compliance with applicable standards of the National Fire <br />Protection Association or other nationally recognized fire -safety standards as are <br />approved by the Fire Marshal shall be deemed as prima facie evidence of <br />compliance with the intent of the fire code. <br />Administrative Order - Page 2 of 40 <br />
