<br />ORDINANCE NO. 20416 <br /> <br />AN ORDINANCE CONCERNING PROHIBITION OF EXTREME <br />FIGHTING; REPEALING SECTION 4.740 OF THE EUGENE CODE, <br />1971; AND AMENDING SECTION 4.990 OF THAT CODE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. On January 8, 2007, the City Council adopted Ordinance No. 20375 adding <br />Section 4.740 to the Eugene Code, 1971, which prohibited extreme fighting except for <br />matches in which the participants and the promoter comply with rules established by the <br />City Manager. <br /> <br />B. In June of 2007, the Oregon Legislature adopted Senate Bill 492, (OR Laws <br />Chapter 585, 2007) which provides that ordinances regulating mixed martial arts <br />adopted by cities and counties before February 1, 2007, may not be enforced once the <br />Superintendent of State Police adopts administrative rules regulating mixed martial arts <br />matches. The definition of "mixed martial arts" contained in Senate Bill 492 includes the <br />conduct defined in the Eugene Code as "extreme fighting." <br /> <br />C. On July 1, 2008, amended Oregon Administrative Rules 230-010-0000 et <br />seq., regulating mixed martial arts matches, became effective. <br /> <br />D. Because the State of Oregon now has sole jurisdiction to regulate mixed <br />martial arts, including the conduct defined in the Eugene Code as extreme fighting, <br />Section 4.740 of the Eugene Code, 1971, which contains the provisions prohibiting <br />extreme fighting, should be repealed. <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOllOWS: <br /> <br />Section 1. Section 4.740 of the Eugene Code, 1971, is repealed. <br /> <br />Section 2. Subsection (1) of Section 4.990 of the Eugene Code, 1971, is <br /> <br />amended to delete the penalty reference to Section 4.740 in the list of penalties; and <br /> <br />Subsection (11) of Section 4.990 of the Eugene Code, 1971, is repealed. <br /> <br />Section 3. The City Recorder, at the request of, or with the concurrence of the <br /> <br />City Attorney, is authorized to administratively correct any reference errors contained <br /> <br />Ordinance - Page 1 of2 <br />20416 (00203047).DOC <br />
