The ayes <br />and nays were called. Councilmen voting aye, eight; nay, none. Absent, none. <br /> <br />I <br /> <br />Councilman Zumwalt further stated that a Mr. Stafford owned some property <br />adjoining the city dump grounds and he wished to put in a joint fence separating <br />the two. The City Engineer stated that the cost of this fence as near as could be <br />estimated would be $65.00 or $70.00, therefore the city's share would be between <br />I $32.50 or $35.00. Councilman Zumwalt moved and Reid seconded that the city pay <br />its share of this joint fence as long as it was within the above specified amount. <br />The ayes and nays were called. Councilmen vot1.ng aye, Reid, Zumwalt, Bond and. <br />Harris; my, Lamb, Hendershott, Simon and Carlson. It being a tie vote, the Mayor <br />broke the tie by voting aye. <br /> <br />.~ <br />~~ <br />..........,. <br />~ <br />;...,.~. <br /> <br />. <br /> <br />The Police Committee by Councilman Simon, asked the council to give the <br />Chief of Police the power to make complete arrangements for the employment of a dog "- <br />catcher on the percentage basis. Upon motion made and seconded, this was unani- <br />mously approved. <br /> <br />Councilman Simon then stated that Councilman Bond of the Police Committee <br />,had been securing bids for the purchase of cars for the Police Matron and the Polic <br />Department and asked that the committee be given power to purchase the same. The <br />Recorder asked Dr. Simon if legal bids had been published in the papers, to which <br />Dr. Simon answered no. Upon motion made and seconded, this permiSsion was granted. <br /> <br />....... <br /> <br />I <br /> <br />At this time, Councilman Simon again presented the suggestion concerning <br />the city's licensing all pin and ball machines, the second quarter being now past <br />due. He stated that the licensing had been held up by reason of the fact that one <br />ball machines were in effect and it had been reported that many of the machines wer <br />paying the winners cash and he wanted to know what the council wanted to do about <br />it. The Recorder at this time pointed out that the present ordinance governing <br />the pin and ball machines specifically provided that awards could be made only in <br />merchandise or merchandise orders; therefore, under the ordinance, tokens were per- <br />fectly permissible but that any machine that paid out cash was in violation of the <br />ordinance and subject to the penalties provided for such. Councilman Reid made <br />the suggestion that it might be possible for the chief of police to secure the keys <br />to all the machines from the distributors and open up the pay-off boxes and if mone <br />were found in them to make an irrmediate arrest. The Recorder pointed out that that <br />would certainly be good evidence if it were, done. Mr. Harry Johnson addressed <br />I the council suggesting the licensing of poker games if they wanted to get some <br />t money and in such games the player had better chances of winning something. Mr. <br />I Gordon Wells, local attorney, representing three distributors, pointed out. that <br />I when the state held pin and ball machines were not lotteries or gambling devices, <br />I. that there were three forms of games being used at that time. 1. Those machines <br />paying out in paper checks. 2. Those that paid out in tokens. 3. and those <br />tha t paid out in money; and that as a matter' of fact there can be no di stine tion <br />between these machines. They are all legal. Councilman Hender~hott moved and <br />Councilman Bond seconded to continue licensing the machines under the present or- <br />dinance. Councilman Carlson pointed out that the members of the council had alread <br />once this year determined that these machines should be licensed and that it seemed <br />to him to be a hardship on the distributors and operators of the said machines to <br />put them on the spot each and every quartef as to whether or not they should be <br />licensed. He suggested that we let the ordinance stand as it now is and follow <br />through on that basis for a period of a year. Question was called for and the <br />motion was carried. <br /> <br />'- <br /> <br />.. <br /> <br />Councilman Simon then asked that the Recorder be authorized to advertise <br />bids for the police radio equipment and upon motion made and seconded it was so <br />ordered. <br /> <br />'- <br /> <br />Councilman Simon then reported on the 13th Street Parking situation betwee <br />Kincaid and Alder Streets and no comments being had, the question was continued. <br /> <br /> <br />Councilman Simon then reported on the traffic condition at the corner of <br />16th and Hilyard Streets as it had been presented by Dr. A. T. Oberg at the previou , <br />meeting and the committee recommended that a stop sign be placed on 16th Street, on <br />the west side of Hilyard Street and upon motion made and seconded, it was so ordere . <br /> <br />I <br /> <br />Councilman Bond then moved that a stop sign be placed at the corner of <br />Broadway and Van Buren and this was seconded, but in the discussion that followed, <br />the motion was withdrawn and the question held for consideration at the next <br />council meeting. <br /> <br />" <br /> <br />Councilman Bond then requested that the stop sign now located at 6th and <br />Polk StrEP, ts be temporarily removed and be replaced when the Prairie Road was again \. <br />opened to traffic. Upon motion made and seconded, it was so ordered and the police <br />were instructed to take care of this. <br /> <br />, It was the recommendation of the police committee that the transfer of <br />license of the operators of the Fir Tree Inn be approved and upom motion made and <br />seconded, it was so ordered.
