The council approved the recommendation of the Commission in passing -the resolution <br /> and the ordinance had its first reading and passed to its second and third readings qy title under <br /> suspension of the rules. The ordinance was deo1ared <br /> passed and numbered 86l7. <br /> I <br /> RES 0 L UTI 0 N <br /> "WHEREAS, vacation of streets, alleys, railroads~ public plaoes and various areas <br /> are at times aocomplished before the attention of the authorities is directed thereto~ <br /> with the possible resul~ that the same may be subjected to a non-conforming <br /> use under the zoning plan of the City of Eugene, thereby dislocating the plans <br /> of ' the City Planning Commission and of the city itself; <br /> THEREFORE <br /> BE IT RESOLVED BY THE PLANNING COMMISSION of the City of Eugene that it 'is necessary <br /> to the orderly development of the City Planning within the City of Eugene that vacated <br /> areas such as streets, alleys, railroads and public places and various other <br /> areas shall automatically be deemed zoned as single family residence districts pending <br /> further action and exa.mina tion by the Planning Commission. And the Planning-Commission <br /> therefore recommends to the Common 00uncil &~ the City of Eugene that it pass an ordinance <br /> directing that upon the vacation of any street, alley, railroad, public place or other <br /> area that the same shall automatic6'ally be zoned as a single family residence district <br /> zone and that no non-con,froming use be permitted therein until the City Planning <br /> Commission shall have taken up, recommenied to the Council~ and the Council shall have <br /> established its status under the city zoning ordinances in conformity wit-h the zoning <br /> plan of the City of Eugene. If <br /> I Further communication from the Planning Commission was pre sented stating that the Commiss- <br /> ion had passed a resolution suggesting certain redistricting of the zones of the city, placing them <br /> 22 VI under different classifications. Upon motion made and seconded the resolution was unanimously <br /> approved. <br /> RES 0 L UTI 0 N <br /> BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE: that <br /> . <br /> I WHEREAS" there has been suggested certain changes in the zoning of certain <br /> areas in the city of Eugene to the Council that the Council does hereby require <br /> the City Plann,ing Commission to recommend the boundaries of such districts as <br /> have been suggested, together with appropriate regulations and restrictions to <br /> be enforced therein; before doing so they shall make a tentative report and hold <br /> a pubJic hearing thereon on Tuesday, September (1:9, 1939, notice of -which public <br /> hearing shall be given by the Planning Commission by publication in a newspaper and <br /> by posting three of the notices upon bulletin boards in the City of Eugene. <br /> That after such hearing the City Planning Commission shall either adopt, <br /> modify or am:lnd their former proposal and file the same with the City Recorder and <br /> thereupon the Council shall hold a hearing thereon as provided by law and either adopt <br /> or reject said report. <br /> ~ <br />
