Stewart to Walter A. Hudson permitting public utilities to use a <br />2EY ive foot strip of his property was referred to the City Attorney to report back. <br /> <br />Communication from I. G. Kjosness attached to a petition asking for a <br />27v street light at 25th and Harris Street was referred to the Fire and Water Committee. <br /> <br />The Eugene Public Library presented their report for the month of Feb- <br />280/' ,ruary. The, report was ordered placed on file. <br /> <br />I A petition from Wayne W. Holmes for a license to operate a motion <br />iPicture theater at 70 West 10th Street was read to the council. Gordon Ramstead <br />'spoke in behalf of Mr. Holmes and said Mr. Holmes intended to make this a permanent <br />~ttraction. He pointed out that the seats in this room would not be stationary as <br />[n a regular theater but the seating capacity would be approximately 300 seats <br />~nd this would be the basis for which he was willing to pay a city license. <br />~Jecessary provisions of the State Fire Marshall's Office and the city fire and <br />health ordinances were to be complied with. He wanted some assurance that if <br />he went to this expense he would be able to secure a license from the city. After <br />~ome discussion by the council a motion was made and seconded that if the re- <br />~uirements of the fire marshall's office and the regulating city ordinances were <br />2~ complied with that a license would be granted to Mr. -Holmes and it was so ordered. <br /> <br />I A written request from ~~~s. C. V. Sinniger asking for a refund of $50.00 <br />jYVhich she made as a dovm payment on the South 60 feet of Lots 1 and 2, Block 4, <br />Fampbell's First Addition was presented. She explained in her letter that due <br />~o unexpected sickness and hospital bills she would not be able to go through <br />~ith the contract to purchase the property. Upon recommendation of the Finance <br />tommittee it was moved and seconded that this money be refunded. The roll was <br />palled, councilmen voting aye: Reid, Hanns, Bond, Farrington, Barette and Cox; <br />hay: nonei absent: Carlson and Koppe. It was unanimously approved that the refund be <br />30 v ~ranted. <br /> <br />II Communica tio~ was presented from IN. J. Scharen regarding a notice that <br />he had received from the city to repair his sidewalk in front of 2005 Franklin <br />II <br />Woulevard. It was stated tl~t City Engineer Clubb had said that owing to the <br />probability of re-locating the highway along Franklin Boulevard that this work out <br />r"here should be held up and nothing done until the direct highway route was knovvn. <br />3lv l11e letter was referred to the City Engineer. <br /> <br />I Corununication was presented from C. M. Bryan, qity Recorder stating that <br />0n March 16, 1940 a copy of the resolution passed by the Common Council on January <br />~2, 1940 regarding fire calls outside of the city limits of the City of Eugene had <br />been mailed to all the subscribers and insurance companies on record in the Recorder' <br />32..1 r'! ffi ce. <br /> <br />I Communication was presented from the Union Central Life Insurance Company <br />an which they returned to the city warrant #52028 in the amount of $64.01 dated <br />".. .. <br />February 29, 1940 WhlCh had been sent them as over payment on WaSI11ngton Street <br />:Waving and sewer assessmerts.. rrhe company asked for an additional sum of interest <br />thich they had paid on this $64.01 at the time the payment was made. The matter was <br />33 v'teferred to the City Attorney. <br /> <br />~ Curb cut applications #726, T. S. Peterson~ #727, Ludwig Kaufman;'and <br />W728, 1~s. Oza Whittenberg, were presented and as the City Engineer recommended <br />~hat the cuts be granted motion was rnade and seconded unanimously approving the <br />~ecorrnlendation. Curb cut application #725, C. P. Tillman, denied at the council <br />weeting of March 11, was presente~ for reconsideration at the request of Mr. Tillman. <br />~. Tillman stated that cars would not be parked across the sidewalk. There was <br />~ome discussion from various members of the council after which motion was made <br />~y Councilman Hanns, Seconded by Councilman Reid to allow the 18 foot curb cut as <br />34 vwreviously asked for.
