WADE COMPANY: BjD FOR A PEERLESS PUMP IN 310 DAYS TIME FOR <br />A COST OF $9,940, THE ENGINEER HAS BEEN INFORMED THAT THE BIDDER COULD REDUCE DELIVERY <br />TIME TO 210 DAYS BY THE USE OF A WESTINGHOUSE MOTOR IN WHICH CASE THE BID PRICE WOULD <br />BE APPROXIMATELY $10,860. R. M. WADE AND COMPANY HAVE FURTHER STIPULATED THAT THERE WILL <br />BE LITTLE OR NO ADDITION TO THEIR PRICE FOR THE INCLUSION OF A VORTEX BREAKER THE NEED <br />fOR WHICH HAS BEEN DEOMONSTRATED BY RECENTLY COMPLETED MODEL STUDIES. THIS SUPPLIER HAS <br />ALSO AGREED TO PROVIDE A LONG RADIUS ELBOW AT NO EXTRA COST IN PLACE OF THE RIGHT ANGLE <br />VANED ELBOW ORIGINALLY PROPOSED. <br /> <br />r <br /> <br />! <br /> <br />THE CONTRACT DOCUMENTS UNDER WHICH THESE BIDS WERE RECEIVED, SPECIFICALLY INSTRUCTED <br />THE VARIOUS MANUFACTURERS OR SUPPLIERS TO ASSUME THAT THEY COULD MAKE FULL USE OF THE <br />OVERLOAD OR SERVICE FACTOR CAPACITY OF ELECTRIC DRIVING MOTORS. IN ALL OF THESE CASES <br />THIS PR6vISION WOULD PERMIT OVERLOADING OF MOTOR UP TO 15%. THE BYRON-JACKSON COMPANY <br />BID IS PREDICATED UPON THE USE OF A 125 HORSEPOWER MOTOR EVEN THOUGH THE MAXIMUM LOAD <br />REQUIRED BY THE PUMP WOULD NOT IMPOSE MORE THAN A 15% OVERLOAD ON A 100 HORSEPOWER MOTOR. <br />THE BYRON-JACKSON COMPANY HAS INDICATED TO THE ENGINEER THAT IF' A 100 HORSEPOWER MOTOR <br />WERE PROVIDED THE BID FOR THE PUMP AND MOTOR WOULD BE $9,831. THE BYRON-JACKSON BID ~ <br />ALREADY ASSUMES THE USE OF A LONG RADIUS ELBOW AND INCLUDES THE VORTEX BREAKER. <br /> <br />I <br /> <br />R.'M. WADE AND COMPANY ACCEPTED THE LIQUIDATED DAMAGES CAUSE IN THE CONTRACT, WHILE <br />THE BYRON-JACKSON COMPANY EXCEPTED THE SAME DAMAGES. THE CONTRACT DOCUMENTS ARE SO <br />WORDED THAT THE SUPPLIER OR MANUFACTURER CAN OBTAIN AUTOMATIC EXTENSIONS IN TIME PROVIDED <br />THEY KEEP THE CITY CONSTANTLY INFORMED OF THE STATUS OF THE MANUFACTURE OF THE PUMP, AND <br />THAT THEY REQUEST A SPECIFIC DELAY WITHIN TEN DAYS OF THEIR KNOWLEDGE THAT A DELAY WILL <br />BE NECESSARY. THUS, MERE ACCEPTANCE OF THE LIQUIDATED DAMAGES CLAUSE DOES NOT NECESSARILY <br />PROVIDE THE CITY WITH PAYMENT FOR LIQUIDATED DAMAGES IN THE EVENT OF A LATE DELIVERY, <br />BUT WILL ONLY SERVE TO KEEP THE CITY CONSTANTLY INFORMED OF THE PROGRESS OF THE MANU- <br />FACTURER Of THE ITEM. THEREFORE, THE LIQUIDATED DAMAGES ClAUSE SHOULD NOT CONSTITUTE A <br />MAJOR CONSIDERATION IN DETERMINING TO WHOM THE BID SHOULD BE AWARDED. <br /> <br />THERE ARE CERTAIN OTHER INTANGIBLE BENEFITS TO BE DERIVED FROM USING AN EQUIPMENT <br />WHICH IS SIMILAR TO OTHER MACHINES OPERATED IN THE EUGENE AREA. IN THIS PARTICULAR CASE <br />THE EUGENE WATER & ELECTRIC BOARD IS NOW PURCHASING FROM THE BYRON-JACKSON COMPANY fOUR <br />PUMPS WHICH ARE ALMOST IDENTICAL TO THOSE PROPOSED BY THAT COMPANY IN THEIR BID TO THE <br />CITY OF EUGENE. <br /> <br />THE ENGINEER HAS REVIEWED ALL OF THESE CONSIDERATIONS AND HAS COME TO THE CONCLUSION <br />THAT THE ACTION MOST fAVORABLE TO THE CITY OF EUGENE WOULD BE THE PURCHASE OF TWO PUMPS <br />FROM THE BYRON-JACKSON COMPANY OF Los ANGELES FOR $9,831.00 WITH A SPECIFIC REQUIREMENT <br />TO THAT COMPANY THAi THE PUMP BE DRIVEN BY A 100 HORSEPOWER MOTOR. <br /> <br />ONLY TWO BIDS WERE RECEIVED FOR THE RECTANGULAR SLUICE GATE. ONE FROM THE E. N. <br />HALLGREN COMPANY OF SEATTLE, WASHINGTON, AND ONE FROM HENRY JULLUM OF PORTLAND, OREGON. <br />BOTH OF THESE BIDS COVERED MATERIAL MANUFACTURED BY THE SAME COMPANY AND THE BIDS WERE <br />FOR THE SAME AMOUNT. INASMUCH AS THE r. N. HALLGREN COMPANY BID WAS IN THE HANDS OF <br />THE CITY BY THE APPOINTED HOUR FOR THE OPENING OF THE BIDS, WHILE THE HENRY JULLUM BID <br />WAS NOT RECEIVED UNTIL LATER, IT IS THE ENGINEER'S RECOMMENDATION THAT THE RECTANGULAR <br />SLUICE GATE BE PURCHASED FROM THE E. N.
