IN THE COUNCIL CHAMBERS. THE ME~TING WAS <br />CALLED TO ORDER BY HIS HONOR, MAYOR V. E. JOHNSON WITH THE FOLLOWING COUNCILMEN PRESENT: <br />CRUMBAKER, BOOTH, GODLOVE, KOPPE, SIEGENTHALER, WATSON AND OwEN. COUNCILMAN CONE TOOK HIS <br />SEAT IN THE COUNCIL CHAMBERS AT 7:45 P.M. <br /> <br />THE MINUTES OF THE LAST REGULAR MEETING HELD ON APRIL 12, 1954 AND ADJOURNED TO APRIL 26, <br />1954 WERE READ AND APPROVED. <br /> <br />A REPORT Of THE SPECIAL COUNCIL COMMITTEE WAS SUBMITTED AND READ AS FOLLOWS: <br /> <br />e <br /> <br />"ON INSTRUCTIONS OF THE EUGENE CITY COUNCIL, THE MAYOR HAS APPOINITD A COMMITTEE <br />TO PREPARE A STATEMENT IN BEHALf OF THE COUNCIL. THE COMMITTEE, COMP05E~ OF COUNCIL- <br />MEN BOOTH, KOPPE, SIEGENTHALER AND CRUMBAKER SUBMIT THE FOLLOWING STATEMENT AND IT IS <br />RECOMMENDED FOR ADOPTION: <br /> <br />PART I <br /> <br />. <br /> <br />I <br /> <br />IT APPEARS THAT THE ISSUE AS TO PROPER ZONING OF THE RECENTLY ANNEXED RIVERVIEW <br />AREA HAS BEEN SO THOROUGHLY CONfUSED BY ATTAC~S ON THE CITY COUNCIL, AND BY MIS- <br />INfORMATION, THAT :THE MERITS Of THE VARIOUS KINDS OF ZONING HAVE BEEN LOST SIGHT OF. <br />OUR FIRST DUTY IS TO DISPOSE OF SIDE ISSUES, AS FOLLOWS: <br /> <br />(A) THERE HAS BEEN NO MEETING OF THE EUGENE CITY COUNCIL WHICH WAS NOT OPEN TO <br />THE PUBLIC OR WHICH WAS HELD IN ANY OTHER PLACE THAN THE COUNCIL CHAMBERS, DURING THE <br />PERIOD SINCE ANY PRESENT MEMBER HAS BEEN ON THE COUNCIL (I I YEARS). <br /> <br />. <br /> <br />THERE HAVE BEEN 198 COMMITTEE MEETINGS DURING THE THREE YEAR PERIOD ENDING APRIL I, <br />1954, TO STUDY SUBJECTS REFERRED TO THEM BY THE COUNCIL. THIS IS NORMAL LEGISLATIVE <br />PROCEDURE, AND THE ONLY METHOD WE KNOW TO MAKE INSPECTIONS AND TO HANDLE THE VOLUME OF <br />WORK THE COUNCIL MUST PERFORM. THERE IS NO REASON TO CHANGE THE PRESENT PROCEDURES, <br />UNDER WHICH THE COUNCIL HAS .THE BENEfiT Of STUDY AND RECOMMENDATIONS BY ITS STANDING <br />COMMITTEES. <br /> <br />I <br /> <br />Of THE 198 COMMI TYEE MEETI NGS, THREE WERE .AS COMMI TYEE OF THE WHOLE. I T WAS ONE <br />OF THESE THREE WHICH WAS MADE AN ISSUE OF THE REfERENDUM. THIS MEETING ON FEBRUARY 2, <br />1954, AT THE MAYOR'S HOME, AT WHICH THE RECORD SHOWS FIVE COUNCILMEN WERE PRESENT, WAS <br />HELD PURSUANT TO A MOTION PASSED IN OPEN COUNCIL MEETING, AND REPORTED THE NEXT EVENING <br />IN THE EUGENE REGISTER-GUARD (PAGE I I-A, JANUARY 26, 1954). No REPORTER INQUIRED CON- <br />CERNING THE TIME AND PLACE Of MEETING, OR INDICATED A DESIRE TO ATTEND. IT WAS NO <br />MORE A SECRET MEETING THAN THE FIELD TRIP CALLED AT AN EARLIER DATE FOR THE ENTIRE <br />COUNCIL AND MEMBERS OF THE PLANNING COMMISSION. VOTERS MUST DECIDE WHETHER THEY BE- <br />LIEVE THAT IT WAS THE MEETING IN THE MAYOR'S HOM€, OR THE WEEKS OF THOROUGH, CONSCIEN- <br />TIOUS STUDY BY ALL MEMBERS Of THE COUNCIL THAT fORMED THE BASIS Of THE COUNCIL'S FINAL <br />DECISION. <br /> <br />e <br /> <br />HOWEVER, THIS COMMITTEE REALIZES THAT HOLDING A MEETING OF THE COMMITTEE OF THE <br />WHOLE IN A PRIVATE HOME, WHILE NOT IMPROPER, GIVES OPPORTUNITY FOR MISREPRESENTATION <br />AND MISINTERPRETATION. IT RECOMMENDS THAT HEREAFTER MEETINGS OF THE, COMMITTEE Of THE <br />WHOLE, NOT HELD IN THE FIELD, BE HELD IN THE CITY HALL OR OTHER PLACE READILY ACCESSIBLE <br />TO THE PUBLIC. <br /> <br />(B) ANALYSIS OF STATEMENTS IN THE EUGENE REGISTER-GUARD DISCLOSES AT LEAST TWO <br />OUTRIGHT fALSifiCATIONS WHICH HAVE CONFUSED THE CITIZENS Of EUGENE ABOUT THE ZONING: <br /> <br />STATEMENT IN REGISTER-GUARD <br /> <br />(EDITORIAL 3/10/54): "THE M-2 CLASSifiCA- <br />TION PERMITS NOT ONLY WAREHOUSES, BUT MANY <br />TYPES OF NUISANCE INDUSTRIES SUCH AS <br />POULTRY SLAUGHTER HOUSES AND PROC~SSING <br />PLANTS FOR FEATHERS, fURS, BONES AND <br />REFUSE MATERIAL." <br /> <br />PROVISIONS Of ZONING ORDINANCE <br /> <br />(SECTION M-2, PARAGRAPH A-12): <br />"POULTRY OR RABBIT KILLING INCIDENTAL <br />TO A RETAI L TRADE ON THE SAME PREMI SES." <br /> <br />I <br /> <br />(SECT I ON M-2, PARAGRAPH A-"8): "MANU- <br />FACTURING, COMPOUNDING, ASSEMBLING, OR <br />TREATMENT Of ARTICLES OR MERCHANDISE FROM <br />THE FOLLOWING PREVIOUSLY PREPARED MATERIALS" <br />(FOLLOWE~ BY A LIST OF 22 MATERIALS, IN- <br />CLUDING fURS, fEATHERS AND BONES, BUT NOT <br />REFUSE MATERIAL). <br /> <br />e <br /> <br />~ <br />
