Purdy,' Wingard and Teague, Mrs. Beal a~d <br />Mr. Mohr. <br /> <br />" <br />" <br />'I <br />" <br />il <br /> <br />Minutes of the meeting of April 28 and May 12, 1969, as mailed to Council members, were approved. <br /> <br />NEW BUS INESS <br /> <br />" <br />:i <br /> <br />Mrs. Hayward 'asked to set the record straight rega~ding reports .that threatening phone calls had <br />been received by Eugene City Councilmen in conn~ction with the arrest of Black Panther member Hurst. <br />Mrs. Hayward had checked with all council members, and none had received any kind of threatening <br />ph~ne call. . <br /> <br />1: <br />" <br />" <br />" <br />" <br />. )I <br />" <br />" <br />" <br />" <br />l' <br /> <br />Councilman Mohr said he had spent the major part of the day in federal court, and that the U.S. . <br />Attorney had' some difficulty explaining exactlywher~ he had received his information. Mr. Mohr <br />had made a statement upholding, the city's p~lice force and it~ ability to handle th~se problems <br />without outside interference from other ag~ncies. Mr. Mohr reported that arguments made for <br />return of Mr. Hurst to this community prevailed, he was released on bail, and will return to the <br />City. <br /> <br />,I <br />I. <br /> <br />Mrs. Hayward asked to discuss the problems of differences in planning and zoning between the Ci~y <br />and the County. Mrs. Hayward felt there was an opportunity to help reso1ve these problems by <br />entering into the Kendall Ford case as a friend of the court. <br /> <br />" <br />" <br />. <br /> <br />Mrs. Hayward moved seconded by Mr. MOhr that the Council authorize the City Attorney to, on behalf <br />of the City, file a request to enter the Kendall Ford case as Amicus Curiae. <br /> <br />In answer to a question from Mr. Mohr, the City Attorney said if the City had continued with inter- <br />vention, he would now be participating in the case, with evidence in support of the plaintiffs. <br />As a friend of the Court, a brief may be filed to accentuate the areas in the case that are of <br />particular concern to the city of Eugene. <br /> <br />Mayor Anderson said he had talked to Commissioner Kenneth Omlid to explain the actioi1.the~Cbuncil <br />might take in this matter. The Commissioner said there is no ill-will felt in this regard. The <br />Mayor explained that the Council would really be carrying on a commitment made previously to <br />support the City's stand in this case. <br /> <br />:i <br /> <br />In answer to a question from Mr. Wingard, the City Attorney explained the reason for an amicus <br />curiae brief is to give the Court an~in~erpretation of law and legal arguments why the Court should <br />find one way or another - to influence the Court in its decision. The City would not be a neutral <br />party, but would be on the side of the plaintiff. No written accusations would he made concern- <br />ing the County position, and the City would not participate in the trial or take objection to <br />evidence. It would only take a position as to the validity of the County action. In answer to <br />Dr. Purdy's question, Mr. Hendershott said work would be done by the staff, and there would be <br />no actual cost. <br /> <br />Mr. Teague did not feel the Council should interefere at this time. It was his opinion that inter- <br />ference might hamper city-county relationships. <br /> <br />" <br />., <br />:' <br /> <br />Mr. Wingard said he had real reticence to enter into lawsuits, but if the City could present its <br />position without sueing someone, Mr. Wingard felt this should be done. He said countless tax <br />dollars had been spent for planning, and some attempt should be made to protect this. <br /> <br />A vote was taken on the motion as stated. Recess, Regular Council Meetings - Mayor Anderson suggested that, since meetings se'em <br />to be getting rather late, a recess between 9:00 and 9:15 might be advisable, if it <br />was seen that the meeting would carryon for at least another hour. Council <br />members agreed, and Mr. Gribskov suggested that arrangements might be made for <br />Council and staff to have coffee at that time. <br /> <br />b. <br /> <br />Airport Repair <br />Mayor and City <br />so promptly. <br />\ <br /> <br />- A letter was read from Congressman Dellenback addressed to the <br />Councilcongratulating them on getting the airport back in operation <br /> <br />( <br /> <br />c. Commemoration, Fred Brenne - Tuesday, May 20 at the Thunderbird Motel, Lane County. <br />Chamber of Commerce, with assist'ance of Eugene Area Chamber of Commerce, will sponsor <br />a commemorative dinner honoring Fred Brenne.
