Councilmen Purdy, McDonald and Mohr were absent. <br /> Minutes of the Council meeting held. July 28, 1969 were approved with a change ~n .the second para~ <br /> I <br /> I ~aph under Milk Inspection to delete the last sentence. <br /> The City Manager reminded Councilmen of the Eugene Renewal Agency meeting Wednesday, August 27, 1969 <br /> at 8:00 p.m. to review planning and designs for the downtown mall. He also reminded Councilmen <br /> of the National League of Cities annual congress December 1st to 4th. <br /> II Field Burning - Statements by Lane Regional Air Pollution Authority were distributed to the e <br /> Council at the request of the Mayor. The Authority is attempting to find a solution to <br /> r accelerat~ the burning program, which will give ,relief to the City, and some financial relief <br /> II to farmers. They have urged the Department of Environmental Quality to encourage burning on <br /> Ii days when winds are from the west or'southwest. <br /> I! <br /> Councilman Wingard said he could not endorse blowing smoke up to Salem and Portland; which might <br /> )1 be caused by southwest winds. The Manager explained that it was felt smoke would dissipate I <br /> II over the Coburg hills, and that Salem had no hills to trap smoke~ Councilman Teague rema~ked <br /> that these were ;jiust suggestions offered to Environmental Quality, for their consideration. <br /> ,I <br /> I Mr. Wingard moved seconded by Mr. Gribskov to place on file. Motion carried. <br /> COMMITTEE REPORTS <br /> II .Committee meeting held August 13, 1969: . <br /> Present: Mayor Anderson; Councilmen Hayward, Wingard, McDonald, Beal and Gribskov <br /> II ~ I <br /> 11 l. Field Burning - Mayor Anderson expressed appreciation to members of the Council for <br /> II taking part in the discussion with the Governor to attempt to alleviate the smoke <br /> I; <br /> .11 problem in the Willamette Valley. He corrnnented that, subsequent to testimony at <br /> II Salem he had called Governor McCall, asking him to come to Eugene. He consented, <br /> and arrived in the City at about 5:30 p.m., meeting at City Hall with Councilmen, <br /> II staff and press. He indicated he would meet with the Attorney General the';morning I.. <br /> I: of August 13 to work out some kind of statement or executive order which would <br /> It determine the course of the future. <br /> II The Board of Environmental Quality is meeting at City Hall the evening of August 13 <br /> ,I <br /> II at 8:30 p.m. to discuss the problem, and try to find a solution. <br /> 11 I <br /> Mrs. Hayward said she had placed before the Council copies of a letter from David I <br /> !, I I <br /> .1 <br /> It Harrnnons reporting on the possibility of institution of legal action by the City to abate <br /> H pollution of air resources, and urging that the City continue, through the courts, its <br /> 11 campaign to clear the air, even though the Governor has invoked the State Attorney I <br /> II General's office to outlaw all field burning. The Council should not feel that the I <br /> II I <br /> problem is being resolved, and take no action on its own. I <br /> II Councilwoman Beal agreed with Mrs. Hayward and urged that the City 'institute legal <br /> II action irrnnediately. I <br /> I' e <br /> Ii Mr. Terry Harrnnons said there are four kinds of action that could be instituted; one I <br /> I: against the Department of Environmental Quality, another against the State Fire <br /> II <br /> II Marshall, a third against the burners themselves, and a fourth to seek injunction <br /> !i against the Fire Chief issuing the permit. In answer to Councilwoman Beal's question, <br /> n Hammons said the City could not sue for damages. This would have to be done under complaint <br /> .1 <br /> I' <br /> j' by individual citizens. <br /> It <br /> " Mayor Anderson said the Council has instructed the City Manager to bring back a <br /> II <br /> 'I recorrnnendation on action to proceed in obtaining legal counsel.,: The Mayor agreed that <br /> II what is done at the State level should not be. considered the City's final move. <br /> I: <br /> Ii Councilwoman Beal said it was hoped a citizens committee could be established to draft I <br /> I' a petition and obtain signatures, especially as regards the health and welfare of the <br /> II <br /> " corrnnunity, petitioning t~e Mayor and Corrnnon Council to bring legal action, because of <br /> 11 the damage incurred by them. Mayor Anderson said it was important to gather data I <br /> regarding effects of smoke on the health and welfare of people in the area. <br /> II <br /> II <br /> II Mrs. Beal moved seconded by Mrs. Hayward that the City authorize an official petition <br /> Ii <br /> II form to be circulated by a citizens corrnnittee against pollution, exact wording of form I' <br /> II to be developed by a committee of the corrnnittee, dealing prfncipally,with the health II <br /> II and safety aspect of the problem. Motion carried. <br /> I' <br /> I <br /> I Councilman Wingard though Council efforts would prove to be very fruitful. The House I <br /> I <br /> ,\ of Representatives is ready for action. H.B. 1228 has been formalized, and a summary '_ <br /> circulated for Council information.
