<br />G~ <br /> <br />e <br /> <br />2/24/70 <br /> <br />inappropriate ordinance in that it: 1) provides for binding arbitrations without consider- <br />ation being given to proper bargaining procedures; 2) chooses two bargaining representatives <br />without giving the city employes the opportunity to select their own bargaining represent- <br />ative, if any; 3) has incomplete and inappropriate utilization of Chapter 295 ORS. <br /> <br />I <br /> <br />In answer to Councilwoman Hayward, Mr. Fraser said this policy would prevent the Council <br />from having to negotiate on an individual basis and yet would provide the right of the <br />Council to make the ultimate decision. <br /> <br />eouncil members discussed various points of the report with the committee. Dr. Purdy <br />asked whether the committee would work with the City Attorney to draw up an ordinance <br />and make this a workable agreement between City, State and employes. Mr. Fraser said <br />that was their thinking, and in answer to Mrs. Hayward, said they had no time schedule <br />in mind. He expiliained that they felt the City Attorney was acquainted with the extent <br />of powers of the City and budget schedules, and that this would be an ideal oppprtunity <br />for the Attorney to acquaint himself with the ordinance. Mr. Fraser did feel this work <br />could be completed before work started on the 1971-72 budget. <br /> <br />e <br /> <br />There was discussion concerning the committee recommendation that the Council go on record <br />as opposed to the present charter amendment proposed by the Firefighters Assoc., and <br />whether the Council wished to do this. <br /> <br />Mr. Conant gave an analysis of the proposed charter amendment and pointed out the flaws <br />in the document. <br /> <br />I <br /> <br />I <br />II <br />I <br /> <br />Mr. McDonald moved seconded by Dr. Purdy that the requests of the committee as outlined <br />in the interim report, be adopted by the Council. <br /> <br />There was discussion whether the City Attorney's office should assume the extra work of <br />preparation of this document. City Attorney said his office would be happy to do so, and <br />would make time available. Manager suggested the Attorney beaauthorized to call in addi- <br />tional assistance if he deemed it necessary. The Attorney agreed. <br /> <br />Mr. Fraser reiterated that the City Attorney is well aware of budget timing, and this would <br />be critical. <br /> <br />Vote taken on motion. Motion carried. <br /> <br />Mayor Anderson pointed out that the committee had certainly brought back innovations, and <br />that he felt this should be a new direction, as far as ~ublic employe relations are con- <br />cerned. He also pointed out that the Council was not finalizing the report, but giving <br />the committee the go-ahead to refine it, and that it should be brought back at the earliest <br />possible date. <br /> <br />3. Appeal from February 3, 1970 Planning Commission decision to continue conditional use permit <br />of Lakewood Mobile Home Park <br /> <br />Planning Commission previously granted a conditional use to Lakewood Mobile Home Park, Hwy <br />99 North. In the opinion of neighbors, conditions have not been complied with, and they are <br />appealing the use. The Plannigg Commission moved not to remove the conditional use. The <br />appeal is to this decision. Staff suggests public hearing March 9, 1970. <br /> <br />Ie <br /> <br />I <br />I <br />I <br />I <br />, <br />I <br />I <br />I <br />, I <br /> <br />Mr. McDonald moved seconded by Dr. Purdy that the City Council call a public hearing on <br />the Planning Commission decision regarding this property for March 9, 1970. Motion carried. <br /> <br />4. Improvement Petitions <br />a. Paving~ Storm and-Sanitary Sewers - Churchill Highlands, 2nd Addition, 100% <br />b. Paving, storm and sanitary sewers - 2nd Addition, Edgewood West - 100% <br /> <br />e <br /> <br />Mr. McDonald moved seconded by Dr. Purdy to approve petitions for paving, storm and <br />sani~ary sewers in Churchill Highlands, 2nd Addition and 2nd Addition to Edgewood West. <br />Motion carried. <br /> <br />I <br />-I <br /> <br />In answer to a question asked earlier in the evening concerning effective date of charter <br />amendment proposed by Firefigh~ers, City Attorney said it would not become effective until <br />next year. About 6? days transpire in the bargaining process, and they would not be in <br />a position to get "this into the budget for next year. <br /> <br />Regarding a committee time schedule, Mr. Mohr suggested that the committee could be given <br />check points along the procedural route. The first check point would be the adoption of <br />the interim report. Secondly, the City Attorney begin deliberation on the legislation. <br />Then go through the whole,series of check points which are not time-bound.
