Anderson at 7: 30 p. m. on. May 11, 1970 ,q in <br />Councilmen present: Mr. McDonald; Mrs. Hayward; Dr. <br />and Gribskov were absent. <br /> <br />Minutes of meetings held April 13 and April 20, 1970, as mailed to Council members, were approved. <br /> <br />Eugene, Oregon was called to order by His Honor <br />the Council Chamber, with the fol~o~ing <br />Purdy; Mrs. Beal; Mr. Mohr.. Teague, W~lliams <br /> <br />I <br />I <br />I <br />,i <br />il <br />'I <br />Ii <br />I <br />I <br />I <br />I <br />I <br />Ii <br />11 <br />il <br />il <br />II <br />I, <br />II <br />I, <br />11 <br /> <br />Public Hearing, Employe Relations Ordinance - Copies of the proposed ordinance were distributed <br />at the committee of the whole meeting, and copies of proposed amendments were distributed at this <br />meeting. On Page 4 a suggested Section 6c has been proposed which would provide that all expenses <br />of the impasse committee should be shared evenly by the City and the labor organization, and on <br />Page 5 a new Section 8 has been suggested, which was recommended by the City Manager to remove <br />ambiguity. Section 9 has been written to prevent the City Attorn~y's ,office from having to bring <br />suit against the City Manager's office. The new section provides for a method of enforcement, and <br />is recommendeq by the committee in its present form. Section 10, standard severability clause, <br />has been added. <br /> <br />e <br /> <br />Mr. Fraiser, chairman of the Mayor's Committee, commented that the committee was concerned about a <br />sharing of expenses provision. Throughout the work on the ordinance th~ committee was conscious <br />of the fact the bargaining representative might not be organized labor, and that the employe might <br />be forced to go to a union for funds. Otherwise, they were in favor of the amendments.r <br /> <br />Councilman Mohr requested that Council Bill 9152 (Vacation of 13th Avenue), be discussed before <br />completing this testimony, since there were many perSGns present on this item. <br /> <br />I <br /> <br />City Manager said the public hearing had been held on closure of 13th Avenue, and that the Council <br />wuld vote again tonight on the reading of the Ordinance. <br /> <br />Mr. Mohr 'moved seconded by Mrs. Hayward that the Council consider the third reading of Council <br />Bi,ll No. 9152. <br /> <br />Councilman Purdy was concerned that the Council had not finished the hearing on the collective <br />bargaining ordinance, and felt this should be continued before entering into another item. <br /> <br />-Mrs. Hayward clarified what Council action would be on this item. She too felt it should have been <br />handled in the proper place, but as long as the Council was into it, they could handle it now. <br /> <br />Vote taken on motion to take out of order. This bill was submitted and <br />read in full the first time at the meeting of May 4, 1970, and held over upon failure to receive <br />unanimous approval for second reading at that meeting. <br /> <br />Mr. Mohr moved seconded by Mrs. Hayward,that the bill be read the third time by council bill number <br />only, with unanimous consent of the Council. Mr. McDonald was opposed so the bill will be brought <br />back for third reading at the next Council meeting. <br /> <br />I <br /> <br />The City Manager reported that the Planning Commission had met with the University Planning <br />personnel at noon, and that a joint meeting with the Planning Commission, City Council and Univers- <br />ity personnel has been suggested for Monday, May 18 at noon. Council consensus was that this <br />time would be satisfactory for such a meeting. <br /> <br />Employe Relations Ordinance, Continuation - Mr. Conant said sharing equally in cost of impasse <br />procedure would appear."to be equitable, but in this setting, employe groups will not have volun- <br />tary participation to agree to and draw up ppovisions. Small employe organizations may not have <br />resources, and would have to join a national organization to be able to share in expense of <br />impasse procedures. <br /> <br />-- <br /> <br />City Manager asked if the committee would object if, in the section pertaining to local represen- <br />tation on the impasse committee, the words "at least" were added. Also,,,it is suggested dead- <br />line dates be moved back one month to give more time for the various procedures. <br /> <br />Mr. Fraser said the committee would have no objection to these changes. <br /> <br />Mr. John Rowley, President of Eugene Police Benevolent Association, said he was not sure whether <br />he was speaking for or against the ordinance. He asked if the ordinance wuld allow a contract <br />or working agreement to be written between the Police Benevolent Assocation and the City which <br />could be renegotiated each year. The City Manager said the Public Employe Relations Board would <br />designate bargaining units. <br /> <br />I <br /> <br />In answer to Mr. Rowley's question concerning fringe benefits, Manager said these could be part of <br />the contract. On binding arbitration the City Council would have veto power. <br /> <br />Mayor Anderson pointed out one of the features of this ordinance was that it allowed flexibility <br />in collective bargaining, and gave the opportunity to make changes as found necessary. <br /> <br />Mr. rraser pointed out that, regarding a labor contract, Public Employe Relations Board would hold <br /> <br />~ <br /> <br />5/11/70 - 1 <br /> <br />I <br />I <br />" <br />,I <br /> <br />e <br /> <br />an election to establish each bargaining unit. <br />
