Anderson at 7:30p.m. on August 10, 1970, in the Council Chamber, with I <br /> 'I the following Councilmen present: Messrs. McDonald, Teague, Purdy, Mrs. Hayward, Mrs. Beal, I <br /> I: I <br /> Messrs. Gribskov, Mohr and Williams. I <br /> I' <br /> Public Hearings <br /> Ii A. Appeal from Sign Code (Continued)(Tiffany Davis) <br /> II The City Manager explained action taken at the. July 27 meeting to continue the hearing <br /> q <br /> 'I for further study. He read a letter addressed to the Council from the League of Women <br /> H <br /> Ii Voters objecting to granting a variance and requesting the Council to refer the issue <br /> I' back to the Planning Commission. <br /> ,I <br /> I, <br /> " <br /> i' <br /> I Rick Cleveland~ attorney representing Mr. Tiffany, presented four additional pictures e <br /> II Mr. <br /> il to the Council. He gave further testimony as to the reasons for seeking a variance, <br /> I: citing the need for identification and the uniqueness of the issue. <br /> " <br /> " <br /> 'i Councilman McDonald questioned what the Planning Commission action would be on this <br /> Ii <br /> Ii issue,. and whether they could change the sign zone so that a variance could be avoided. <br /> 11 <br /> Ii Councilwoman Hayward agreed that Mr. Tiffany's appeal had merit, and felt referral to I <br /> Ii <br /> Ii the Planning Commission might be the proper action. <br /> " <br /> II <br /> " Mrs. Hayward moved to refer this matter to the Planning Commission saying to them <br /> :I <br /> I' <br /> Ii that the ?ign ordinance is not working in the way the Council hoped it would and <br /> II requesting recommendations for amendments that would make such signing possible. <br /> :1 Councilman Williams felt this was a sound suggestion. <br /> " The Council would probably <br /> I' <br /> I: face a number of similar situations in the future. He supported Mrs. Hayward's I <br /> I' <br /> II feeling this sign should be permitted through rewriting of the ordinance, rather than <br /> Ii by variance. Dr. Purdy agreed that the idea had merit. I <br /> il Mr. Teague seconded Mrs. Hayward's motion. <br /> 'I <br /> II <br /> I <br /> I: Councilman Gribskov was concerned at the delay in placing the sign'and felt there <br /> II <br /> I should be some council action that would allow Mr. Tiffany to put up his sign until <br /> 1: <br /> 'I the Planning Commission could act. <br /> " <br /> " <br /> Councilman Williams suggested that the motion could be amended to allow a temporary <br /> 180 day variance to Tiffany Drug Company for this sign, and at the end of that time <br /> perhaps the ordinance would be amended or a variance permanently granted. <br /> I: In answer to Councilman Teague, the Mayor said passage of this amendment would allow <br /> II <br /> ,I erection of the sign requested by the appellant for a designated length of time. <br /> I! I <br /> I; <br /> " <br /> ;i Mr. Mohr concurred with Mr. Williams:1 suggestion. <br /> )! I <br /> j; <br /> ii Councilwoman Hayward was concerned with the implication of that kind of sign, and how I <br /> " difficult it would be to remove the sign, once it was in place. <br /> !i <br /> I <br /> " Mrs. Beal agreed that the sign code should be corrected to take care of the problem, <br /> and did not feel a variance should be granted, even on a temporary basis. <br /> Mr. Williams argued that he had no quarrel with this particular variance, but he did - <br /> feel the Council should seek to correct the problem. The Council would still have <br /> , the option to revoke the permission at the end of 180 days. <br /> ,. <br /> i Vote taken on amendment to grant 180 day variance to allow T~ffany Davis request <br /> II in the matter of this sign. Motion carried with Mr. Teague and Mrs. Hayward voting no. I <br /> ~ I <br /> I' <br /> , Before the vote was taken on the main motion Councilman Mohr commented that Council <br /> 'I should not refer every appeal from the Appeal Board to the. Planning Commission for <br /> I; <br /> " revision of the ordinance. <br /> [I <br /> Ii <br /> " Mayor Anderson reminded the Council that this was a relatively new ordinance and <br /> il <br /> 'I there would certainly be flaws which would require amendment. <br /> :1 <br /> " <br /> t! <br /> Ii Vote taken on main motion to refer this question to the Planning Commission, requesting <br /> :' 1< <br /> \: them to consider a sign boundary change or ordinance amendment to allow existance <br /> :1 of a sign, as indicated in this particularl:case.
