<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Appointment to Toxics Board <br /> <br />Meeting Date: August 11, 2008 Agenda Item Number: 2D <br />Department: Fire & EMS Staff Contact: Glen Potter <br />www eugene-or.us Contact Telephone Number: 682-7118 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br />Pursuant to unanimous nomination by the Toxics Board, the council is asked to appoint Stephen Flanagan to <br />that board. <br /> <br /> <br />BACKGROUND <br /> <br />The City Charter, in Section 54, provides that the Toxics Board shall consist of seven members: three <br />representing manufacturers required to report under the Toxics Right-to-Know Program, three with a record <br />of advocating for the public’s right to know, and one who must be nominated by at least four of those six. <br />This final position is Position 7 on the board. <br /> <br />The term of office of the previous holder of Position 7 expired in October 2007. No applications for the <br />position were received during the City’s normal recruiting process that year. Soon after, the Toxics Board <br />directed a special recruitment process, with advertising in The Register-Guard and Eugene Weekly. Those <br />advertisements attracted four applications for the position. <br /> <br />After reviewing the applications, the board rejected one candidate, James Tarantino, who disclosed that he <br />was working under contract for a business required to report under the Toxics Program. The board’s view <br />was that this individual might encounter a conflict of interest as a member of the board, and the board also <br />acknowledged the unlikelihood that the candidate would attract the four board votes required for nomination. <br /> <br />The board interviewed the other three applicants – Stephen Flanagan, James Robertson, and Rex Stevens – <br />on June 16, and voted 6:0 to nominate Mr. Flanagan for appointment to the board by the City Council. Mr. <br />Flanagan’s application and supplemental questionnaire are attached.
