Rules of Conduct for Council Meetings <br /> I, C.B. 9g03 - Adding to Eugene Code new section 4.727 (regarding distrubing or breaking up public <br /> ;: <br /> I meetings or assemblies) and declaring an emergency, was submitted, and no councilman <br /> I <br />e j: present requesting that it be read in full, was read the first time by council bill <br /> " number only. <br /> i, Res. 1971 - Amending Res. 1761 adopting by-laws governing proceedings and conduct of the Common <br /> ,I <br /> I Council of the city of Eugene, Oregon, and adding Article V, was submitted. <br /> I' <br /> " <br /> " . <br /> I' <br /> The City Attorney felt further specifics should be listed in Paragraph 3 of the ordinance, <br />.1 and revised Paragraph 5, which refers to taking of photographs in the Council Chamber. <br /> Section 9 was added by the Council Committee after it met with news media and discussed <br /> their concern that the rules might interfere with carrying out of their responsibility. <br /> I City Attorney Arthur Johnson explained changes made in the ordinance and resolution, and <br /> reasons for the changes. He commented that Paragraph 9 had been added at the suggestion <br /> of the committee, and that it was his feeling that the news media was adequately covered <br /> under Paragraph 3, and he questioned whether Paragraph 9 really attained anything. <br /> 1; To Councilwoman Beal the City Manager explained that several members of the news <br /> media had proposed legislation which was discussed and revised at the committee meeting. <br /> It was then proposed for Council consideration. <br /> ;, Mr. Hershner explained that, at the subcommittee meeting, it was felt Subsection A-3 <br /> " under Section 3 might limit the news media. For this reason, he was in favor of <br /> addition of this provision. <br /> Mr. Teague outlined the history of appointment of the committee and drafting of the <br /> ordinance. He said the Council agreed a set of definite rules was needed to guide <br /> public participation and to give the Council enforcement power. He explained the <br /> ordinance and how it was written. <br /> " <br /> City Manager explained that, since the committee meeting, the City Attorney had <br /> I' rewritten the ordinance. <br />I , <br /> , <br /> " <br /> City Attorney explained that the original draft of the ordinance was based upon <br /> provisions of the present state statutes. The language is quite general and has broad <br /> application. The new draft is much more specific regarding prohibited conduct. <br /> Councilman Hershner commented that an "intentional" element had been added. <br /> ,. City Attorney said that the ordinance woilild better define "Willfully" by the addition <br /> 'I <br />e of the word "intentional." <br /> Councilman Williams asked for further definition of the word "intentional". <br /> Would <br /> this change the meaning of the law? <br /> City ktorney explained insertion of this word and his reasoning for including it. <br /> There was further Council discussion of the ordinance and its relation to the previous <br /> draft. <br /> City Manager asked whether, in Subsection 1, other public bodies and official groups <br /> ,I might be included. City Attorney said the language could be broadened to include them. <br /> Bill Beaton, 1828 Emerald, said proceedings which took place in the Council Chambers <br /> last spring were not commendable. He thought some portions of the resolution were <br /> agreeable, but he felt the Council should not pass it at this time, and should discuss <br />I it further. He was concerned about the small seating capacity of the Council Chamber <br /> and urged the Council, when hearing items of extreme public interest, to meet in <br /> another place. He also felt it was very restrictive to insist that persons speaking <br /> give names and addresses. He felt too that there should be more restriction on <br /> photographing in the Chambers. <br /> Don Bishoff, Assistant City Editor, Register Guard, said an informal committee of the <br /> news media had met with :theCouncil Committee. He .said the news media did not like <br />e to feel themselves in a ispecial class, but in order to tell the public what has gone <br /> one, it is sometimes necessary to do things not permitted members of the general public. <br /> ( 9/27/71 - 1 <br /> ..o1l <br />
