<br /> Mayor Obie thanked Mr. Baker and the other delegation members for their report <br /> to the council. Mayor Obie said he hopes there will be many exchanges between <br /> e Eugene and Kakegawa. He said Eugeneans can learn much from Kakegawans and <br /> Eugene's economy will be related to the economies of Japan and other Southeast <br /> Asian nations for the next 100 years. <br /> Mr. Holmer said he has been in Kakegawa twice. He thanked Mayor Obie and other <br /> members of the 1986 delegation for representing the City so well. <br /> II. PUBLIC HEARING: WILLAMETTE GREENWAY CODE REVISIONS <br /> City Manager Mi chea 1 Gleason introduced consideration of the Willamette <br /> Greenway Code Revisions. Planning Director Susan Brody gave the staff report. <br /> She said the proposed code revisions respond to concerns raised by the Oregon <br /> Department of Land Conservation and Development (DLCD) during its evaluation <br /> of the Metropolitan Area General Plan Periodic Review. <br /> Ms. Brody said the Planning Commission studied the DLCD concerns, reviewed the <br /> testimony from two public hearings, and unanimously recommended the proposed <br /> revisions to the council. She said the revisions continue to require approval <br /> of a conditional use permit for development within the Willamette Greenway but <br /> the revisions modify and clarify the criteria which must be met when the <br /> request for a conditional use permit is considered. The revisions clarify how <br /> proposed development must conform to the Metro Pl an, how use management <br /> considerations in Statewi de Goal 15 (Willamette River Greenway) apply to <br /> proposed development, and how the term "greatest possible degree" should be <br /> interpreted. <br /> e Ms. Brody said the DLCD staff reviewed the revisions recommended by the <br /> Planning Commission and expressed two concerns. They suggested the revisions <br /> requi re a defi nite setback from the ri ver and they said the term "greatest <br /> possible degree" in Section 9.260 (2) should be defined better. Ms. Brody <br /> sa i d the DLCD staff indicated that they might raise the issue of the <br /> definition of "greatest possible degree" to the Land Use Board of Appeals if <br /> the Planning Commission's recommendation is not changed. Therefore, the City <br /> Attorney and the Planning staff recommended the following change to Section <br /> 9.260 (2) on page 3 of the proposed ordinance. (Words in parentheses should <br /> be deleted. Underlined words should be added.) <br /> As used in this section, the words lithe greatest possible degree" <br /> are drawn from Statewide Planning Goal 15 (F.3.b) and are intended <br /> to require a balancing of factors so that each of the identified <br /> Greenway criteria is protected to the greatest extent possible <br /> without (unreasonably burdening an otherwise permissable urban) <br /> precluding the requested use. Goal 15 (C.3.j.) provides that <br /> "lands committed to urban uses within the Greenway shall be <br /> permitted to continue as urban uses. II <br /> Ms. Brody said the criteria and standards in the revisions address most of the <br /> concerns of the DLCD about setback standards and no change to the Planning <br /> Commission recommendation is needed in that regard.
