<br />ORDINANCE NO. 20414 <br /> <br />AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD <br />METROPOLITAN AREA GENERAL PLAN (METRO PLAN) TEXT, <br />CHAPTER III, SECTION D, POLICY D.ll; ADOPTING AN EXCEPTION <br />TO STATEWIDE PLANNING GOAL 15 WILLAMETTE RIVER <br />GREENWAY; ADOPTING SEVERABILITY AND SAVINGS CLAUSES; <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Chapter IV of the Eugene-Springfield Metropolitan Area General Plan (Metro <br />Plan) sets forth procedures for amendment of the Metro Plan, which are implemented for Eugene <br />by Eugene Code Section 9.7730(3), for Lane County by Lane Code 12.225(2)(a & b), and for <br />Springfield by Chapter 5, Section 5.14-100 through 5.14-155 of the Springfield Development <br />Code. <br /> <br />B. On February 1, 200S the Oregon Department of Transportation (ODOT) <br />submitted an application to the City of Eugene for a Metro Plan text amendment, an Exception to <br />Goal 15 Willamette River Greenway for the 1-5 Willamette Bridge Project, and an application <br />for a text amendment to the Willakenzie Area Plan to allow the placement of fill within 35 feet <br />from the top of bank of the Willamette River. <br /> <br />C. A joint public hearing of the Planning Commissions of the City of Eugene, City <br />of Springfield and Lane County was held on April 29, 200S and a joint public meeting of the <br />three Planning Commissions was held on June 3, 200S. Following the June 3, 200S meeting the <br />Eugene Planning Commission recommended approval of the Metro Plan amendment, taking an <br />exception to Statewide Planning Goal 15 Willamette River Greenway, to the Eugene City <br />Council. <br /> <br />D. The Eugene City Council conducted a joint public hearing on this amendment on <br />June 24, 200S with the Springfield City Council and Lane County Board of Comnlissioners, and <br />is now ready to take action based upon the above recommendation and evidence and testimony <br />already in the record as well as the evidence and testimony presented at the joint elected officials <br />public hearing. <br /> <br />E. Substantial evidence exists within the record demonstrating that the proposal <br />meets the requirements of the Metro Plan, of Chapter 9 of the Eugene Code, 1971, and of <br />applicable state and local law as described in Exhibit A, attached hereto and which are adopted <br />in support of this Ordinance. <br /> <br />Ordinance - 1 <br />
