<br />e' <br /> <br />(0001) <br /> <br />(0042) <br /> <br />e <br /> <br />- <br /> <br />M I NUT E S <br />EUGENE CITY COUNCIL <br />March 10,1975 <br /> <br />Regular meeting of the Common Council of the city of Eugene, Oregon was called to order <br />by His Honor Mayor Lester E. Anderson at 7:30 p.m. on March 10, 1975 in the Council <br />Chamber with the following Council members present: Neil Murray, Ray Bradley, D.W.Hamel, <br />Eric Haws, and Edna Shirey. Council members Gus Keller, Wickes Beal, and Tom Williams <br />were absent. <br /> <br />Mayor Anderson noted thet this was the last Council meeting Hugh McKinley <br />would attend as city manager. The Mayor expressed his personal thanks and <br />the Council's appreciation for the manager's fine service. Mr. McKinley <br />responded that he had enjoyed his 14 years with the city, that it was a <br />gratifying experience because of the two mayors and the people who had <br />served as council ~embcrs, all giving so much of their time. <br /> <br />I - Public Hearings <br />A. Liquor License Application - The Winery, 90 Oakway Mall COAl - New <br />Requested by Gary OlSOl1. <br /> <br />Mr. Keller moved seconded by Mr. Hamel to set public hearing on the <br />application for the March 10 Council meeting. Motion carried <br />unanimously. <br /> <br />Comm <br />2/26/75 <br />Pub Hrng <br /> <br />Oregon Liquor Control Commission report indicated from interviews in the area <br />that four objected to the issuance of the license, 17 did not object, and four <br />were noncommittal. Staff had no reason to recommend against the application <br />other than that the building was not yet constructed and city codes would have <br />to be met prior to issuance of a certificate of occupancy. <br /> <br />Public hearing was opened'. <br /> <br />Fred VanHerwaarden, operator of The Bavarian, a restaurant at 444 East 3rd Avenue, <br />said he had applied for a "hard liquor" license which had been denied by the OLCC <br />after the city's recommended approval. He said the basis of the Commission's <br />denial was too many outlets in that area, mentioning the Charter Oak Restaurant <br />license in the Oakway Mall at that time but since discontinued. How he was' <br />wondering why a new establishment would be considered before his application. <br />Also, whether the city's recommendation was considered by the OLCC. He asked <br />what procedure he should follow if this license was granted. Manager answered <br />that the city's recommendation is required, but it mayor may not be followed <br />by the OLCC. Normally, if the city recommendation is negative rarely does the <br />OLCC issue the license although they have the legal authority to do so. If the <br />city recommendation is favorable, the OLCC frequently denies the license because <br />of a different set of standards. There are only so many licenses issued per <br />thousand population. He added that Mr. VanHerwaarden had the right to testify <br />before the OLCC when this license was considered. He also had the right to re- <br />apply for his greater privilege license. <br /> <br />Public hearing was closed there being no further testimony. <br /> <br />Mr. Murray moved seconded by Mr. Hamel to recommend approval of the <br />application. Motion carried unanimously. <br /> <br />B.
