A major change would be to establish a new process <br />II whereby the director of the Parks Department will have authority to enact <br /> new rules, subject to public appeal by petition to the Council. ~e noted I <br /> the Council had received a copy of the ordinance, as well as the rules and , <br /> regulations, and staff was recommending approval. I <br /> I <br /> , <br /> I <br /> C.B. 1714--Concerning Department of Parks and Recreation; repealing ! <br /> Section 4.270, 4.335, 4.900, 5.155, 5.620, and 5.625 of Code, I <br /> I <br /> 1971; amending Sections 2.007, 2.391, and 2.1990 of that Code; I <br /> adding Sections 2.812, 2.813, 2.814, 2.815, 2.816, and 2.817 to <br /> the Code; and declaring an emergency was read by council bill <br /> number and title only, there being no Councilor present requesting <br /> it be read in full. <br /> Mr. Hamel moved, seconded by Mr. Bradley, that the bill be read <br /> the second time by council bill number only, with unanimous I <br /> consent of the Council, and that enactment be considered at I <br /> this time. t <br /> f <br /> Mr. Obie was concerned regarding whether or not the public had been \ <br /> I <br /> apprised of the new rules and regulations and the ordinance. Assistant <br /> Manager noted the agenda item had been well advertised and no public ~ <br /> testimony had been received at last week's meeting. Mr. Obie then wondered t <br /> ~ <br /> to what extent the Council was releasing its powers to the administrative ! <br /> level. Assistant Manager replied actually very little. He said what was I <br /> more accurately happening was a process of administrative regulations <br /> which will require more public scrutiny and notice. The Council will i <br />-- always have the prerogative to change the ordinance in any way, and the I <br /> staff will keep the Council apprised of the rule changes. He noted the \ <br /> entire City Code is replete with delegation to the City staff of various I <br /> , <br /> I <br /> responsibilities. At any time there is an expansion of that responsibility, I <br /> it is a matter for City Council to consider and delegate. In the past, , <br /> park rules and regulations have not had an adequate basis in the Code to , <br /> , <br /> ! <br /> allow effective enforcement. This ordinance would clarify that matter and , <br /> also open the process for public scrutiny. Mayor Keller noted also if the I <br /> Council felt it was not adequate, the ordinance could be changed at a <br /> later date. Assistant Manager also noted the two-step process before <br /> the rules and regulations would be in force: A notice of public hearing <br /> for proposed changes, and a 30-day lapse before the rules would go into I <br /> effect. Council will receive notice of the public hearing and the proposed ; <br /> rule changes. Assistant Manager also emphasized the appeal process in <br /> which an individual or group can present its case to the Council. , <br /> Vote was taken on the motion, which carried with all Councilors <br /> present voting aye, except Mr. Obie voting no. Lacking unanimous <br /> consent, the council bill will be held for second reading to <br /> July 26, 1978. <br />III. Resolutions Carried Over from July 12, 1978, Meeting <br /> Assistant Manager said the first three resolutions were routine improve- <br /> ment petitions.
