<br />e <br /> <br />M I NUT E S <br />EUGENE CITY COUNCIL <br />January 16, 1980 <br /> <br />------------------------------------------------------------------------------- <br /> <br />Adjourned meeting from January 14, 1980, of the City Council of the City of <br />Eugene, Oregon, was called to order by His Honor, Mayor Gus Keller at 11:45 <br />a.m., Council Chamber, with the following Councilors present: Betty Smith, <br />Scott Lieuallen, Jack Delay, Eric Haws, D.W. Hamel, Brian Obie, Gretchen Miller, <br />and Emily Schue. <br /> <br />------------------------------------------------------------------------------- <br /> <br />I. ITEMS FROM MAYOR AND COUNCIL, APPOINTMENTS, ANNOUNCEMENTS, AGENDA ADJUSTMENTS <br /> <br />A. Appointments and Announcements <br /> <br />1. Council committee assignments--Mayor urged Council members to make <br />their wishes known concerning committee assignments for this year. <br />Manager said an up-to-date list will be distributed by the end of <br />the week. <br /> <br />e <br /> <br />2. Lighting the cross on Skinner Butte--Manager explained that the <br />Veteran's group has requested permission to light the cross <br />on Skinner Butte during the Iranian crisis. The City asked the <br />attorney to prepare an opinion on the legality of this action. <br />Mr. Spickerman, Hearings Official, prepared a memorandum for the <br />Council which said that, within the terms of the City charter and <br />the opinion of the US Court of Appeals, the City would be violating <br />the law by participating in this activity. <br /> <br />3. Condominium conversion--Manager said they will be preparing a <br />release on the City's interpretation of the litigation in Portland <br />on the condominium conversion moratorium ordinance after receiving <br />the judge's eight-page opinion. <br /> <br />Mr. Long explained that Judge Burns has issued a 20-day prelimi- <br />nary injunction against enforcement of Section 1 of the ordinance. <br />It provides that any action taken by the developer during that <br />period of time would have to be contingent upon their successfully <br />avoiding the moratorium. Anything the developers do has to be <br />conditional. The order is expected today. Mr. Long said they had <br />looked at the actions that might be taken. Newspaper accounts <br />from Portland indicate the judge's opinion contains language <br />suggesting it would enable veterans whose benefits might expire by <br />January 31, 1980, to make application for veteran's loans on the <br />condition that the loan would go forward when the moratorium is <br />lifted. <br /> <br />e <br /> <br />1/16/80--1 <br />
