<br /> ~ <br /> Ms. Briqqs stated that the proposed annexation includes five plots. Tax Lots <br /> 100. 200. 1000 are approximately 26 acres under private ownership. Gilham <br /> School, Tax Lot 4900, includes approximately 19.6 acres. City parkland. Tax Lot e <br /> 1403, contains approximately 6.67 acres. The annexation request represents <br /> consent of 100 percent of the affected property owners. The area included in <br /> the annexation/ rezoninq request is contiquous to the existinq city limit line <br /> alonq the western boundary of the school district and City park property. The <br /> area is separated from the city limit line to the south by two tax lots totalina <br /> approximately 20 ~cres. The southern boundary for the area requested for <br /> annexation is approximately 400 feet north of the existing city limit line on <br /> the east side of Gilham Road. The city limit line west of Gilham Road extends <br /> northward to Ayres Road. The full Gilham Road riqht-of-way is within existing <br /> city limits. Owners of the two parcels of land south of the school and park <br /> site are not interested in annexation at this time. The City recently has <br /> annexed two parcels in the area and there,have been recent annexations nearby. <br /> Mr. Lieuallen asked if the Desler/Allen property is under litiaation with <br /> respect to the qoals. Ms. Briqgs stated that it is not, to her knowledge. <br /> Mayor Keller called for ex parte contacts or conflicts of interest. Mr. Obie <br /> stated that he leases land adjacent to the site for a radio tower and will <br /> abstain. <br /> Staff notes and minutes were entered into the record. <br /> Public hearina was opened. <br /> Speakinq in favor: - <br /> Mike Yeager, 1170 Pearl, represented Arabian/Wester. He stated that with <br /> approval of this request, they would like to develop low-density residences. <br /> They intend to improve the road to the standard right-of-way. The Metro Plan <br /> update is the basis for this request and it is consistent with the 1990 Plan. <br /> The request was delayed until the Metropolitan Plan update was finished. This <br /> request has been evaluated against the updated General Plan and Statewide <br /> PlanninaGoals. He feels the request should be approved based on five criteria: <br /> relationship to the urban service boundary, availability of puolic services, the <br /> need for developable residential land and increased geographical distribution of <br /> land, loqical boundaries~ and contiquity. This area has been desianated low- <br /> density residential for the past 12 years, was reaffirmed by the Planninq <br /> Commission in 1977, and is within the most recent urban qrowth boundary. All <br /> public services are either available or imminently available to the property. <br /> All of the schools in the area are under capacity. This development will <br /> provide direct benefits to Gilham School. In exchanqe for school district <br /> dedication of right-of-way to the City, the applicant, at his expense, will <br /> install a 24-foot-wide section of road, construct a 6-foot buffer strip, place a <br /> 5-foot sidewalk and I-foot strip between the south side of the road and school <br /> property, and install a 6-foot fenc~ between the sidewalk and school property <br /> for separation between the playqround and the road. There is a need to maintain <br /> an adequate supply of developable residential land and a need to provide qeo- <br /> graphical distrihution and choice.
