Speaking in favor of the appeal: Dan Kovtynovich, 1595 Skyline Park Loop, stated that he is representing Eldon Kovtynovich. He noted that this issue has gone all the way to Circuit Court. The person who owns this lot has changed a garage into living quarters which requires that he get a panhandle lot designation. The City Attorney ruled that the Circuit Court decision had no bearing. It does not seem right to tell a citizen he can do something if he will be held in contempt of court. This would not be in the best interests of the subdivider to partition this property. This is similar to the situation in Hawkins Heights. There being no further testimony, public hearing wa~ closed. Ms. Miller moved, seconded by Mr. Obie, to deny the appeal. Ms. Schue stated that it is her understanding that the City is following its rules for minor partitions and the applicant has met those criteria. Mr. Gleason added that anything further on this case would be a civil disagreement and would be civilly enforced. Ms. Miller added that if the City gets into deed restriction enforcement that could cause real problems. e Roll call vote; motion carried unanimously. B. Public Works Bid Awards (tabulations attached) 1. Sanitary sewer to serve area from 160. east of Harrison Street to Glenwood Boulevard and between Southern Pacific Railraod tracks and i60' south of Glenwood Drive (960). 2. Sanitary sewer on Mill Street at 18th Avenue to serve Tax ,Lot 17-03-32-3 3--19600 (1968). 3. Sanitary sewer reconstruction to repl ace exiting 8" sanitary sewer line south of Mission Avenue and east of Van Ness (1947) . 4. Storm sewer in Villard, 13th Avenue and Moss Street from 15th Avenue to Garden Avenue (1937). 5. Storm sewer construction on 22nd Avenue, from Washington Street to 1/2 block east of Lawrence Street (1960). Public hearing was opened. There being no testimony, public hearing was closed.
