Staff notes and <br /> minutes were entered into the record. <br /> Public hearing was opened. <br /> Speaking in favor of the appeal: <br /> Dan Kovtynovich, 1595 Skyline Park Loop, stated that he is representing Eldon <br /> Kovtynovich. He noted that this issue has gone all the way to Circuit Court. <br /> The person who owns this lot has changed a garage into living quarters which <br /> requires that he get a panhandle lot designation. The City Attorney ruled that <br /> the Circuit Court decision had no bearing. It does not seem right to tell a <br /> citizen he can do something if he will be held in contempt of court. This would <br /> not be in the best interests of the subdivider to partition this property. This <br /> is similar to the situation in Hawkins Heights. <br /> There being no further testimony, public hearing wa~ closed. <br /> Ms. Miller moved, seconded by Mr. Obie, to deny the appeal. <br /> Ms. Schue stated that it is her understanding that the City is following its <br /> rules for minor partitions and the applicant has met those criteria. Mr. <br /> Gleason added that anything further on this case would be a civil disagreement <br /> and would be civilly enforced. Ms. Miller added that if the City gets into deed <br /> restriction enforcement that could cause real problems. <br />e Roll call vote; motion carried unanimously. <br /> B. Storm sewer in Villard, 13th Avenue and Moss Street from 15th <br /> Avenue to Garden Avenue (1937). <br /> 5. Storm sewer construction on 22nd Avenue, from Washington <br /> Street to 1/2 block east of Lawrence Street (1960). <br /> Public hearing was opened.
