ADMINISTRATIVE ORDER NO. 21-18-08 <br />of the <br />City Manager <br />DELEGATING TO THE ASSISTANT CITY MANAGER AND THE <br />DIVISION MANAGER FOR THE CITY MANAGER'S OFFICE THE <br />AUTHORITY TO APPROVE, MODIFY, OR DENY REQUESTS <br />CONCERNING PROHIBITING SMOKING ON PUBLIC RIGHTS-OF- <br />WAY OUTSIDE OF DOWNTOWN CORE (OPT -IN), AND ALLOWING <br />SMOKING IN DESIGNATED AREAS INSIDE OF DOWNTOWN CORE <br />(OPT -OUT), PURSUANT TO ORDINANCE NO. 20603. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the <br />City Manager is designated as the administrative head of the City, and is specifically authorized <br />to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce <br />all ordinances of the City. <br />B. On July 23, 2018, the City Council adopted Ordinance No. 20603 amending Section <br />6.230 of the Eugene Code, 1971 ("EC"), by adding EC 6.230(2)(q) to provide that the City <br />Manager may approve requests to create smoke-free areas on the public right-of-way adjacent to <br />smoke-free properties outside of the downtown core (opt -in); and by adding EC 6.230(2)(r) to <br />prohibit smoking within the downtown core and provide that the City Manager may approve <br />requests to create designated smoking areas in the downtown core (opt -out). Ordinance No. 20603 <br />will become effective on August 24, 2018. <br />C. On August 15, 2018, I issued Administrative Order No. 21-18-07, adopting <br />Emergency Rules implementing Ordinance No. 20603 by setting out how approval under EC <br />6.230(2)(q) and EC 6.230(2)(r) can be obtained, and that such requests shall be approved, approved <br />with modifications, or denied by the City Manager or the Manager's designee. <br />D. I find it would be more efficient and in the public interest to authorize the Assistant <br />City Manager and/or the Division Manager for the City Manager's Office to approve, approve <br />with modifications, or deny requests for approval. <br />NOW, THEREFORE, <br />The City Manager of the City of Eugene Orders and Directs that: <br />1. The Assistant City Manager and/or the Division Manager for the City Manager's <br />Office are authorized to approve, approve with modifications, or deny requests submitted pursuant <br />Administrative Order - Page 1 of 2 <br />
