City Manager Pay Adjustment and Contract Amendment <br />Councilor Taylor pulled Item E from the Consent Calendar. <br />MOTION AND VOTE: Councilor Clark, seconded by Councilor Taylor, moved to approve <br />the items on the Consent Calendar, except for Item E. PASSED 8:0 <br />Council Discussion <br />• Important to note that giving the City Manager an $11,000 pay adjustment raise is close to <br />the income of people staying at Ya Po Ah Terrace; this is too much. <br />• Consider re-examining how Council conducts evaluations during a process session. <br />MOTION AND VOTE: Councilor Clark, seconded by Councilor Taylor, moved to approve <br />Consent Calendar Item E. PASSED 7:1, Councilor Taylor opposed. <br />3. PUBLIC HEARING AND POSSIBLE ACTION: An Ordinance Extending the term of Ordinance <br />No. 20397 granting to Comcast of Oregon II, Inc. a franchise for operation of a cable <br />telecommunications system, and providing an effective date. <br />City Manager Jon Ruiz introduced the Public Hearing topic. <br />Mayor Vinis opened the public hearing. No one signed up to speak for this Public Hearing. <br />Mayor Vinis closed the public hearing. <br />MOTION AND VOTE: Councilor Clark, seconded by Councilor Taylor, moved to adopt <br />Council Bill 5197, an ordinance extending the term of Comcast franchise agreement. <br />PASSED 8:0 <br />4. ACTION: An Ordinance Concerning the Skinner Butte Height Limitation Area, and <br />Amending Section 9.6715 of the Eugene Code, 1971 ( City File CA 18-3) <br />Mayor Vinis made statements related to the subsequent three Council actions, stating that the <br />records for the quasi-judicial decisions had closed the week before. Council continued to receive <br />emails related to these decisions and there are legal issues to address; the ex -parte contacts and <br />whether the emails will be included in the record. <br />Council Discussion <br />• Each Councilor made a statement related to emails they had read after the record closed <br />and stated that they could still be impartial. <br />• Obie Companies has chosen not to rebut the ex -parte contacts. <br />Assistant City Attorney Lauren Sommers addressed the quasi-judicial records for the subsequent <br />actions and the steps Council could take to address the testimony submitted after the record was <br />closed. <br />MOTION: Councilor Clark, seconded by Councilor Taylor, moved to reject all testimony <br />received by the City regarding the proposed Skinner Butte Height Limitation Ordinance <br />and the proposed Gordon Hotel Sign Ordinance (CA 18-3) following the close of the <br />records for those ordinances on Monday, July 16, 2018. <br />MINUTES — Eugene City Council Meeting July 23, 2018 Page 2 <br />
