ORDINANCE NO. 20293 <br /> <br />AN ORDINANCE CONCERNING CITATION AUTHORITY <br />OF UNiVERSiTY OF OREGON DEPARTIVlENT OF PUBLIC <br />SAFETY ON UNiVERSiTY PROPERTY; ADDING <br />SECTION 4.035 TO THE EUGENE CODE, 1971; AND <br />AMENDING SECTION 4.906 TO THAT CODE. <br /> <br />Section 1. Section 4.035 of the Eugene Code, 1971, is added to provide: <br /> <br />4.035 <br /> <br />~__e_partment of Public Safety of University of Oreqon - Citation <br />Authority(. <br />(1) Public safety officers of the University of Oregon are authorized to <br /> issue citations for violations of this code if: <br /> (a) The violation occurs on University of Oregon property in the <br /> presence of the public safety officer; <br /> (b) The public safety officer has reasonable grounds to believe that <br /> the conduct observed constitutes a violation; and <br /> (c) The city manager has approved an intergovernmental agreement <br /> with the University of Oregon containing such terms as the city <br /> manager determines are appropriate. <br />(2) As used in this section, '"violation" means an act made unlawful by this <br /> code that is punishable by a fine but not punishable by a term of <br /> imprisonment. A "violation" may carry a penalty of punishment in <br /> addition to a fine as long as the punishment does not include a term of <br /> imprisonment. <br /> <br />Section 2. Section 4.906 of the Eugene Code, 1971, is amended as <br /> <br />4.906 False Information to Peace Officer or Enforcement Officer for a <br /> <br />Citation. A person commits the offense of giving false information to a <br />peace officer or enforcement officer for a citation if the person knowingly <br />uses or gives a false or fictitious name, address or date of birth to any peace <br />officer or enforcement officer for the purpose of the officer's issuing or <br />serving the person a citation under authority of section 4.035 of this code, <br />ORS 133~055 to 133.076, 133.110,419C.085 or ORS chapter 153. <br />"Enforcement officer," as used in this section, means a public safety officer of <br />the University of Oregon authorized to issue citations for violations pursuant <br />to section 4~035 of this code. <br /> <br />Section 3. The City Recorder, at the request of, or with the concurrence of the City <br /> <br />Attorney, is authorized to administratively correct any reference errors contained herein <br /> <br />Ordinance- 1 <br /> <br /> <br />
